NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

1000 replies

nauticant · 19/11/2025 22:05

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to: [email protected]

I actually know Carol Potter, she is a friend of mine of longstanding. You’ve all constructed a persona for her ( based on assumptions and inflammatory newspaper articles) that I do not recognise.
There are entirely legitimate reasons why she could choose to retire this summer that you don’t know about.
You’ve all been a bit too about gleeful about the outcome, I think it is very unpleasant and not constructive at all.

I’m sure your pal Carol is a lovely friend. Never forgets your birthday and is a generous host.

But the antics of NHSFife do not reflect well on her and her leadership. She’s either been a coward for not standing up to the gender idealogues, incompetent for not knowing what was going or she’s a fully paid up ideologue herself.

There is a bit, but Naomi isn't having it and stands up for herself as well as we'd all expect, which is brilliantly.

The only disappointment for me is that it was a radio recording. I was hoping it was filmed because I wanted to see more of her outfit.

Thank you for posting. I think Ms Holt needs educating.

I think there was something quite magic about freeflowing it in real time. It was a bit hectic doing the TT C+P, and inventing the magical-realism events in the courtroom plus The Fifer's take, all at once, and I didn't get much work done those days cough cough.

It didn't allow too much time for self-editing, which was maybe a good thing - I am a massive overthinker and not having time to think too much probably helped the flow.

I don't know if I would be better if I had more time to sit and percolate, maybe I'd be worse!

You were a genius. A radio show would be amazing!

Which inflammatory newspaper articles and what outcome are you referring to?

Lots of the posters here watched the tribunal live via the court’s stream or in person. Many of the rest of us followed along thanks to the live tweeting authorised by the court. Far from personas constructed from assumptions and unflattering inflammatory newspaper articles, our impressions of NHS Fife’s management has been informed by their own evidence out of their own mouths and what that conveyed about the culture presided over by your friend.

Zebracat · 27/11/2025 19:56

The journalist interviewing NC keeps saying he’s not going to challenge everything she says, but does, and also heavily criticises JKR as if it’s reasonable to have NC answer for her. But, despite that he is at least pollite, which is more than most interviewers on this subject have been. But oh my saying that having a gay child and a trans child requires the same loving response . Grr. And yes , I have been in both situations.

socialdilemmawhattodo · 27/11/2025 20:02

I can't read the whole article but if "you" are choosing to take early retirement, why would you receive an enhancement? So even more that suggests she has been pushed and told firmly enhancement would be inappropriate. Under the circumstances.

Anyone announcing early retirement in their 50's is odd. I am an older professional, different industry. Retirement age now even for my age group is late 60's. Private pensions are different. So Carol retiring early, not on grounds of ill health, or family commitments (often used for a board sacking), what are the general public to think? She is going before she is properly pushed, no enhancement confirms that. SP might not be perfect but she didn't deserve to be asked to change in front of a known man, because your friend didn't have the capacity to lead and question this. Many of us on here have been questioning this for nearly a decade.

socool · 27/11/2025 21:02

How many other dominoes will fall now, and those in charge slip quietly out the door before actual retirement date....

INeedAPensieve · 27/11/2025 21:10

Hoping the verdict will be tomorrow. Looks like it's pointing towards this.

Or, the "no pay out" is intended to confirm she's leaving of her own volition ie no compromise agreement

I daresay she's a kind and loyal friend. And perhaps she's unlucky that this incident happened to occur on her patch. Could just as easily have been a different health board

But, expecting a woman to share changing facilities with a man was never OK. And she's in charge. So ....

It took evidence across 20 days and was covered closely by media in the UK and internationally.

This from the BBC article (just not by them) made me giggle!

I suppose you could say, they haven't lost their sense of humour!

WallaceinAnderland · 28/11/2025 02:12

A reddit poster thinking very much along the same lines as us

"I am very concerned that Cunningham is taking time out to do press appearances up here in Scotland, esp given her high volume of cases. She didn't have time to represent SM at the supreme court for GLP vs EHRC, but she has time for this.
The judge in Peggie vs NHS Fife said parties would get 5-10days notice on the judgement.
It is 9 days since the NHS Fife's head announced her unplanned early retirement"

If she's leaving for positive reasons we don't know about then she can share our glee. 🎉

If she's going under duress because she stubbornly persisted in leading NHS Fife into a shitshow of a tribunal, despite certain knowledge that the suspension and investigation and witch hunt of Sandie Peggie was based on a terrible lie, then good riddance to bad rubbish xx

I'd be utterly ashamed to be friends with someone who treats vulnerable women this way. It's telling you're more offended by our opinions of her than her hateful, vile and despicable behaviour.

So Carol Potter is taking some form of action against those newspapers for the ‘inflammatory articles’, presumably? Which ones?

I hope she doesn’t mind you coming on here and talking about her private stuff.

Discussion and Community Sources:

These sources consistently reference updates from Peggie's legal team (e.g., barrister Naomi Cunningham) and tribunal insiders. No exact date has been set, as is common for employment tribunals, but the consensus points to December 2025 at the latest.
