NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Are there any statistics about (to use the vernacular) MtF and FtM? I get the impression the former is significantly more prevalent. If that is correct, have there been any studies why this might be the case?

Where was that reported? It certainly seems likely that she and the entire Board were either involved or hiding in a sealed bunker over the weekend that the press release was released and re-released, and discussed in almost every part of the press.

Sorry, can’t remember. And it could just have been a journalist assuming that she must have done. If it’s seen as potentially part of a campaign of persecution of SP, they’ll have to produce all the documentary evidence relating to the whole sorry Press Release saga for the new action. If Ms Potter was responsible, she would have had to go.

I have another thought on this. Apparently journos at the Courier did a FOI on that statement NHS Fife issued during tribunal that effectively accused Sex Matters of instigating threats of violence m. They want to see how the decision was taken and how it was drafted. The FOInwas refused and so they’ve asked for the next step which is for the documents to be reviewed to see if NHSFife reasons for refusal stand up. The documents haven’t been handed over so a legal enforcement is in place which gives them six weeks to pony up.

i know wonder if her early retirement is because she masterminded (stupid minded?) this?

So knowing the documents will
ultimately be released and show her to be a complete tit, perhaps, they got the retirement deal in place. They will then have about 3months I guess to hand over the docs, for an investigator to review them and for the decision to be made about whether they can be given to journos taken.

I strongly suspect the threats of violence would be shown to have come from the TRA side.

I'm sure this came up at the time. Didn't JR say the tribunal was moved due to threats - implying towards her side, but it turned out the threats were made to SP - or NC, I can't remember which one.

Fucking loonies! The citizens arrest bit would be almost funny if it weren't so serious that it caused them to move the tribunal to a whole new city.

Yeah, it caused mild hysteria in February when the R's witnesses and counsel proceeded to misgender Upton one after the other, and everyone really wanted them to be citizen arrested on the way out of court.

@CrocsNotDocs The parties involved get a little advance notice. Sometimes they are comments on twitter about decisions being due.
