No, they would be previous inconsistent statements (anything that contradicts testimoney)

Yes, that's her, rebax. I hope Naomi knows what she's doing - this sounds awfully thin so far. Wouldn't surprise me if she has no real right to the "Professor" title, though, e.g., was briefly a visiting professor twenty years ago and has been using it ever since. (Someone said people carry on using the title after retirement whether or not officially Emeritus/a - they may, but that's very much not on.)

Definitely agree..NC could say that's not what you said before.

It is not.in Sara/Naomi's interest to start this again because of the cost to her. It is rare for legal costs to be reclaimed in employment tribunals. Also as a PP said above, it was going really well in her favour.

We must also consider Mac's reputation with the court and clients.

She wouldn't make this application if she wasn't sure because a frivolous application affects how she's treated in court in the future. Also would we want her as a barrister if she's fucked this up?

And Naomi has 20+ years experience. She's not naive. She knows she has to be on solid ground.

I can't see NC going for this unless she's sure.

Obviously, you can't prove a negative, but if she has some insider knowledge that stuff has been wiped from SM, PB is not likely to contest it?
