Is this the worst possible outcome?

Not entirely because PB has gone.

Boiledbeetle · 14/11/2025 16:35

MarieDeGournay · 14/11/2025 16:33

Pain caused by FM would explain the wince/making a face, and the need to move around and take painkillers - I know this for a fact😒
But to then recuse yourself because of it.... I've been very devils advocate-ish about DB, but this seems to be a very convenient way out for her and the judge.

It's an interesting time to drop out due to a fibro flair up.

MyrtleLion · 14/11/2025 16:36

From NW

restart on Tuesday, possibly Tuesday afternoon. What do you want to do?
NC can we rise for 5 minutes to take instruction?
J FIVE minutes. I hope there is no objection if PB goes home.
[Panel rises. PB makes eye contact with room. Says "thank you" and walks (some might say...

... stalks) out]

thewaythatyoudoit · 14/11/2025 16:33

Is this the worst possible outcome?

Well, it's a foreseeable outcome, so NC should have expected it.

SionnachRuadh · 14/11/2025 16:36

I suppose if you've got a fuming judge there's an argument to be made for having a confrontation, instead of letting her fume through the whole hearing.

Maybe that's why she was twitching at mention of TW being men?😏

Well, they have got rid of PB but that might scupper any attempt to take it on to quasi appeal. Thy have a now furious and insulted judge and other panellist to contend with.

ickky · 14/11/2025 16:40

The judge seemed a quite hostile to NC anyway, maybe the Judge will now try to be scrupulously fair.

Redshoeblueshoe · 14/11/2025 16:40

I must say I find it odd that it took them almost an hour to come up with that excuse discuss such a reasonable reason.

You're right. That should have taken them five minutes to decide.

She wasn't doing anything hostile beforehand, as far as I could see. She didn't want a discussion of trans issues, and forcus on employment law was all going great with the Event that wasnt, and now we're right in the middle of those issues

I know this is probably minor to the point of irrelevancy, but I'm baffled by the whole Professor thing. I understand what people have said about it probably being honorary for a visiting role she's done at some point, but why would she use it when working on a tribunal but not mention it on Linkedin? All she has in the education section is some o-levels.

And was calling herself professor in 2006.

I can find no digital footprint for DB or Re3 that have any credibility. No links to a HE or links post 2004 to a company other than those registered and dissolved by DB and her family.

I have Fibro and one thing I couldn't do during a pain flare would be to rush in a Usain Bolt-esque manner to be out of the door first (IIRC NC said that she rushed to be out first) - in fact I would still be trying to stand from my chair while everyone else was out of the hearing room!

RedNine · 14/11/2025 16:43

My legal knowledge is zero so uhmm IDK what to think now.

Shortshriftandlethal · 14/11/2025 16:43

Sorry, what is the judge's name? I joined this thread late.

Fibro can flair up at any time, but especially if you've been sitting in the same position for a long time.
Either the judge is lying through her teeth, or that is indeed why DB made a face/winced and asked for a break.

Assuming the judge is not prepared to perjure herself to defend DB, that cancels out the 'biased because of facial expression and leaving the room' accusation against DB.

There is also a possibility that DB - who is in her 60s as well as having FM - realises that she just isnt' up to sitting through these long tribunals any more, and when she was the subject of all this drama about bias/recusal etc this morning, just thought feck this, I've had enough, lit and fig.

My attention is more on the judge, and the implications if she knows more about DB's motives for quitting than she's admitting - which would be really serious.

Kucinghitam · 14/11/2025 16:44

As a complete civilian in these matters, the whole thing seems to have been rather a shambles.

MyrtleLion · 14/11/2025 16:44

From NW

Plausible deniability

DeanElderberry · 14/11/2025 16:45

Fibro is not so obliging as to only flare when someone says something controversial. If only.

WandaSiri · 14/11/2025 16:45

I was sitting in a seminar with back pain once. I shifted my position, winced and squirmed intermittently throughout, not solely when the speaker said something I didn't approve of.
