NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

I really like the fact that many GC claimants, witnesses, intervenors are prepared to take be so open with their witness statements, submissions etc. It gives an air of confidence that they know their arguments are solid and based in law and facts.

Am I being a bit dim here, but couldn’t those arguments be just as easily tuned around and made to fit a scenario in which, for arguments sake, a woman’s right to a single sex space removed by a TIM muscling in on her was in fact a case of her life choices being removed by a discriminator upholding the predjudice of someone claiming they are a woman when everyone and their dog knows they are a man. Or something like that.

The JR argument would work in the case of a transwoman being excluded from a male only space - or having nowhere to change but not being excluded from a female only space because the comparator is a man without the pc of gender reassignment

Someone, possibly @MarieDeGournay , asked whether sexual harassment was related to the sex of someone or sexual intercourse. It is both, and the image below is from the NC submission saying it is inherently sexual (as in intercourse not characteristic) for a man to be in a women’s changing room.
