NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

I have subscribed to his Substack just for this month and have a small number of subscriptions to "gift." I don't know exactly what time it will be, in the past they sent me an email when it was about to start. It's recorded so subscribers can watch it later anyway.

Well, it's a good point. If a doctor changes their name e.g. through marriage or divorce, do they get a new registration?

Can any doctors advise?

I didn't get a new registration when I married and changed the surname I used professionally.

More seriously as someone gender critical with a very clearly Jewish last name, I am very used to it being mangled deliberately (and strangely brought up completely irrelevantly) in conversations, as a passive aggressive technique. I’ve also been the recipient of unwanted bodily fluids. Hmm I don’t wear scrubs or even work for the NHS just to be clear, this is in public places like walking down the street. Not so passive with the aggression there.

So complaining about poor hurty feelings from just hearing your own fucking name…yeah, my sympathy is none existent. I’m also not changing my name as I’m not a fucking coward.

Edit: Just realised you'd answered, you're right they're teacakes. I'm a Tunnocks caramel wafer eater, I don't really like the teacakes - I guess that leaves more teacakes for @Boiledbeetle , if her stash of wafers looks a little light it's coz I've been a bit snacky... sorry Boiledbeetle😅

Isn't it usual for counsel for the parties to make their written submissions in open court available? By submitting them aren't they entering them into the public record? Can they be obtained from the court if not the parties?

To limit access to the court and the other parties surely (a) goes against the principle of open justice and (b) suggests a reluctance to broadcast the submissions and/or a lack of confidence in them.

Although I can see why JR might not want her submissions to be available in black and white for scrutiny by all, isn't it odd for a KC, presumably with some professional pride (however misplaced), not to put them out there?

And given that NC has, it's not a good look.
