NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

With more time to address it, and was only for a short time. C says that something is missing from documentation- but there is not a smoking gun. Safety allegations: C says that DU has this made up to have C removed, but DU has strenuously denied this.

What?? Louise C looked up a few rules. She STILL only heard Dr U, and NOT Ms Peggie. What sort of word trickery is this barrister attempting? The only account they got was from Upton.

I think she means it was on DU’s account and the NNC Code of Practice.

Exactly. JR is just waving away the fact that DrU's version was taken as 100% the truth before SP was asked what happened.
So JR's earlier point that it was SP's behaviour in the CR, not her beliefs which caused the problem is invalid as a defence, given that they did not have an objective version of what SP's behaviour actually was.

I'm back home and JR is still waffling on! Here are the bits I missed from the herald:

3:32pm
Ms Russell now questioning the prisons comment made during the Christmas Eve incident.
In the closing argument, Ms Peggie's legal team says the nurse told Dr Upton that it was "just like that person in the prisons".
Ms Russell says the submission "is not quite right about the extent of the common ground" here.
She says it was a reference to the Isla Bryson case, a convicted double rapist who only started to transition after they had been charged.
"It is clear and obvious that the reference to Isla Bryson is a reference to somebody who is a convicted rapist, and the words, 'it's just', are an explicit comparison.
"That is the unvarnished, unstretched position. There is nothing dangerous or unsafe about Dr Upton."
She says that comparing them to someone "who's committed the most heinous crime of sexual violence is an outrageously harmful, hurtful and damaging slur."

Ms Russell now questioning the accuracy of some of the details in Ms Peggie's submission.
In the closing submission, Ms Peggie's legal team says Dr Upton had already begun to undress and could not leave until he had finished changing
"But that's not why," Ms Russell says. "She had already changed before the exchange. The reason why she said she didn't leave during the exchange was because she didn't want to be accused of not listening."

G Malone decided investigation needed, but ED took the action. C says policy not followed - no risk assessment - but policy doesn't require one. Says management should think c shift patterns, and R did so.

Allegation that datix is inaccurate is misunderstanding. It refers to escalation of prior behaviours with Nurse refusing to acknowledge Doctor in situations. No inconsistency between docs. Confidentiality. C says broken by R and that C only person who got reminder in July.

Dep med director would need to know. Dir of Nursing, General and Service Managers in A&S, DU's line manager, the consultants would need to know - for eg if DU so upset that she would need to go home from her shift.

Isla Bumba - inevitable she would need to know - and four people from HR. All would need to know. No one contaminated the I/x. The I/x was done by A Glancey.
