NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #50

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It will resume again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Just catching up with this thread. Thread 50 mental!

Fife changing the rules for staff travelling to from work in uniform. Yes it kind of provides a work around but it doesn't address the problem.

Staff do sometimes need to change at work. TW are not women shouldn't be in women's changing room nor should they be sharing wards with women

I can't believe Fife haven't learnt to 'put their top lip over the bottom one and button it' they just keep digging big holes.

I wonder if any schools or LAs that get sued would be able to sue in turn ScotGov for instructing them to break the law?

I don't know. Wouldn't it depend in the nature of the instruction? Regulations on the statute book might be one thing, guidelines another, conditions attached to funding yet another.

We could see a very profitable time for lawyers.

In my experience they just tick "no conflict" and carry blithely on prioritising their trans employees.

My trust's Gender Identity policy had a page for Impact Assessment, and just ticked "positive effect" against all the protected characteristics.

Anyone else suspect that NHS Fife will resolve the issue by making both changing rooms on the A&E floor unisex and making the rooms in the "dank basement" single sex - with all the women forced to go down a flight of stairs into what appears to be a relatively unused area and change in the tiniest of spaces? So the men will get 3 changing rooms and the women one very small one.

Since NHS Fife seems to be determined to continue to break the law I can't see why they won't try it.

I do hope that Sandie Peggie wins and wins handsome damages and at that point, they decide that it might be a good idea to buck their ideas up.

Yes, thanks for this, I just checked.

The email also says:
"If you no longer require access, please email [email protected] by no later than Friday, 22 August 2025 to allow the Tribunal to redistribute the link to somebody else."

So if anyone is hoping to get a place after missing out last time, it may be worth emailing to ask if there is a reserve list.
