NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #50

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It will resume again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

I read a couple of Boswell's "reports". I didn't realise they were supposed to be serious court reports as they read to me as parody and were markedly inaccurate on factual points. If anyone had relied on them for information about the case they would have been seriously misled. I thought the weakly humorous parody was possibly American, but I suppose America is where AI gets most of its information from.

If he intended them to be accurate reports I'm not surprised at the arguments.

I too gave up reading boswelltweets as I found them inaccurate plus the style was really irritating. The final straw was the day Lottie Miles gave evidence when the boswelltweets report was totally at odds with what I had observed. To discover that it was AI producing the reports explains a lot. From the Twitter spat it appears that he is bigging himself up claiming to have a live observer etc when all it was is AI plagiarising Tribunal Tweets.

I think the most surprising thing about that Herald article is the fact that NHS Fife has a communications team. What on earth have they been doing throughout this debacle!!!

TBF I think the comms team were quite busy, just look at the press releases in the first few days of Part 2 of the Tribunal. They can give the EDI team a run for their money when it comes to incompetence, adding to their workload at the same time.

Yes, and their whole legal defence is a comms strategy. They made it seem like an issue with 1 employee only (SP) as opposed to NHS-wide, and then they discredited SP (racism etc). That is a comms strategy to minimise impact and draw less attention to themselves and gather more support instead.

Plus they seemed to have never admit liability throughout so therefore are focused on managing their own risk, even though it’s likely aspects of their defence are not strong.

They also seemed to use the fanfare around the data requests and ICO involvement to twist a new argument. At first they didn’t want to release data then they were compelled. So they pivoted to say “we’ve spent all this money, it’s a waste of public funds, we don’t want to continue this but no choice as SP determined” etc.

Some might not like the strategy but sounds like textbook public sector comms!
