Sandie Peggie facing internal misconduct hearing this week!

Utterly mind-blowing to read that NHS Fife is pressing ahead with a disciplinary hearing this Friday against Sandie Peggie, despite the Employment Tribunal not having completed its work. Sandie isn't taking this lying down and has started separate legal proceedings according to The Telegraph, which also includes the stunned reaction of Michael Foran to the news in its report.

the money wasted by NHS Fife on this whilst waiting lists balloon. My mother in law died due to incompetent medical professionals in Fife. I’m not remotely surprised they are more interested in harassing a nurse who wants to change without a man watching her than provide healthcare

This is beyond belief, when you’re in a hole as deep as the one they’ve dug for themselves the last thing you do is keep digging! What a bunch of spiteful, vindictive people they have ‘running’ NHS Fife.

The one positive to this is that it’s already receiving a huge amount of mainstream media coverage, which will hopefully peak more people, but it’s going to be awful for Sandie, I really feel for her.

I wrote to my Labour MP on Friday asking for clarification on this government’s policy on single sex spaces, citing this case, maybe we should start bombarding them about this in order to force them to deal with it.

Open letter to Chief Executive of Fife NHS,

Dear Carol,

Yesterday I spent the day with my sister who is severely ill in an Ambulance outside a hospital, she is still there now.
NHS money should be spent on care not spurious employment tribunals.

Why do you think it is okay to discipline, perhaps sack a nurse with 30 years' experience for this? Why do you think it is okay allow a man in a woman's changing room? Why do you think it is okay to waste NHS money on this? Why do you not understand that you as a woman are complicit in the institutional abuse of women?

Where/When was the misgendering supposed to have occurred? Does it include when she was being cross examined?

The panel would be highly unlikely to use that as it would be a direct challange to the sitting judge.

And the staff member who decided to use that would need good indepandant advice. Afaik the judge can issue a bench warrent for anyone and have a person appear to explain why they believed the ruling (which covers the media/general public too) was wrong.

The behaviour of NHS Fife is shocking but at the same time I'm not shocked. I worked in the NHS for 26 years, they truly believe they can treat staff how they like. Bullying is rife, ignoring employers rights is rife, HR are a joke. And sadly all too often patient care is not the priority.

The people of Fife need to rise up and protest outside the health board/ hospital, because as Michael Foran said yesterday, their behaviour is likely to cost NHS Fife a lot more money in aggravated damaged. It does look as if they've decided to burn the house down before they're all sacked.

I thought some misgendering occurred when talking to the investigators?
It's a no-win for Sandie.

Option A: 'there is a man in the changing room' (= misgendering)
Option B: 'there is a woman in the women's changing room' (=no cause for complaint)

I don't think you can sack someone for misgendering someone at a meeting when a) the misgendered is not present, so no harassment occurring, b) Upton's own council misgendered him 21 times (someone on Twitter was counting) in court and c) the Forstater ruling, which allows that Sandie is not required to go along with another member of staff's beliefs/ delusions. I imagine she will be accompanied to the meeting by her formidable legal team. Thank goodness she has someone who is backing her and covering her legal fees.

I think this could very badly damage Jane Russell's reputation. She'll be forever associated with defending the Fife shitshow and losing badly.

What I personally would guess on what you’ve just posted is that Fife’s lawyers have realised if she’s not an employee the Tribunal has no power to make recommendations if she wins in July (ie to change policy following a finding it is unlawful) and so have assessed sacking her now is better than letting her win. I hope they’ve misjudged this, because the law on ordering recommendations relating to successful claims of discrimination from former employees is not settled law by any means. I think if an ET thinks Fife have done what I allege they’ll find for Peggie and make Fife take it to the EAT.

It’s a very high-stakes gamble, given the allegations appear to relate to a very long time ago. Hard to see how it isn’t going to be nailed on unlawful discriminatory dismissal and victimisation. Trouble is even with final salary pension costs the Trust are happy to spend our money continuing unlawful policies.

I don't really see how that works. Surely sacking just leads to a potential unfair dismissal claim, and if she wins the current tribunal proceedings that will effectively mean they have no defence?
