Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

NHS England's policy allows transwomen access female facilities irrespective of the stages of transitioning. I've been told that “Even if there would only be one transwoman excluded from the female facilities, we would consider that unjustifiable unlawful discrimination.” Beggars belief!

Thank you all for sharing and supporting, we're 60% there. Grateful, if you could share again or get 3-5 friends support this.

@FayeRC Yes all the NHS policies I've seen allow men to access women who are undressed and vulnerable from the second he says 'I'm IDing as a woman/ non binary now'.
But in fact there is no 'stages' in transitioning anyway.

A lot of people think it involves surgery- it doesn't. NO surgery is required to 'transition' - mostly it's just a change of clothing and changing the name on your gas bill! Most men who say they are women keep their penis (& the few who do have surgery prioritise getting chest implants). And as sex is immutable and women have human rights too, they have no place in spaces where women/ girls are undressed, for reasons of female privacy, dignity and safety.

@Chariothorses Yes, I agree, and with GRC, employers can't share with employees whether a person has one or not, but even if they could, it would still be meaningless because it can mean some changes or no changes at all.

Does anyone know how local trusts develop their own policies on this? They're very similar to the national/central one, but wording is different, so I'm wondering where the wording comes from at local level. Astonished that ALL trusts seem to have gotten it wrong!

I don't think employers would know whether or not their employees have got a GRC.

Hello all,

I've lowered the target to take into account a more specific VAT calculation and I also need to reach the initial target v soon to cover preliminary costs, and it's an all or nothing target.

I finally managed to make a donation, and I'll invite a friend to participate too - we both donated to Jo Phoenix's crowdfunder, iirc.

These cases are so valuable, and it's brave women who bring them for all of us.
