Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

It would be amazing, if everyone who supported already could get another 2-3 people support this as well, we'd reach the initial target in no time. We need to start the prep for preliminary hearing rather urgently.

I've just donated. I wanted to wish you good luck and let you know that I wouldn't have known about this case if it weren't for mumsnet so it was a good decision to let us know here. Fingers crossed this case can go all the way.

In case readers would like an example of the deliberate cruelty and discrimination towards women as a sex and GC (believers in material reality) due to trans activist NHS staff and policies:
Here are examples of a current NHS Trust policy (University Hospitals Birmingham NHS Trust):

1- anyone - staff or patient - (ie any man who says he is a woman or non binary)- can use the opposite sex (ie female) toilets/ changing rooms/ ward

2- staff (eg female nurses) who object to getting their kit off in front of men who say they are women are threatened with disciplinary action (ref 3.2.13

3 - patients (eg women!) who object to being vulnerable, undressed and asleep in communal areas with male strangers who say they are women are described as 'discriminatory', and threatened with removal from the hospital and withdrawal of treatment (ref 3.2.14).

4- there is 'absolutely no obligation for a transgender staff member to disclose their gender history' ( ie the Trust don't record staff sex, so cannot respect the rights of patients to same sex intimate care for privacy, dignity & safety) .

5- The Trust gives further specific examples if what they consider to be the worst discrimination - yes it's women wanting female only wards or the use of correct sex pronouns. (Even though the Equality Act itself gives female hospital wards as an example of where all males, whatever their gender beliefs, can be excluded!).

These examples are taken from the current University Hospitals Birmingham NHS Trust Policy 'Supporting Individuals who are Transgender' - the Trust have confirmed this week this policy is in current operation. (It was supposed to be reviewed in Sep 2022). Their contempt for the Equality Act, material reality and female staff and patients is shocking.

And this is being reflected in policies across the NHS.

I can't work out how to link the whole thing so here are excerpts (there are 2 documents about trans people):
3.4.3 The staff member must be treated as their preferred gender in the transition period. This will include wearing the appropriate uniform and having access to and using the preferred gender’s facilities i.e. toilets and changing areas.

3.4.5 There is absolutely no obligation for a transgender person to disclose their gender history as a condition of employment.

Best of luck OP.

I wonder How many workplaces up and down the country already say that a transperson can use the toilet that suits their gender identity best, thus making them unisex. It’s not easy, to say the least, for many (most?) employees to raise concerns or questions.

To add to all the other info about the NHS, the thing that horrifies me is that the NHS also often has rules that say that people HAVE TO get changed for their shift at work and changed out of their uniform at work before they leave. They can't opt out. It's awful.
