Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

More I think about it, more important I think this case is. As I understand it, equality law allows service providers to provide single sex facilities and services where justified, including allowing them to exclude trans identifying people with a GRC. I suppose it was assumed, when that legislation was drafted, that employers would automatically apply that exemption to changing rooms or toilets at work. I can't really think of a more clearly justified example, so if it doesn't apply here, what's the point of the exemption? (Except maybe rape crisis centres, looking at you ERCC and RCS!)

It needs to be clear that employers have to provide single sex facilities, which are genuinely single sex, not self ID gender, not legal sex, actual, biological, factual sex, and that it's discrimination to fail to provide single sex facilities for women when they're taking their bloody clothes off. Being forced to change in front of someone you know is male, and told you're a bigot/ may be disciplined for objecting, sounds horrible and humiliating.

It was infuriating to hear the women and equalities select committee chair squirming on Woman's Hour this week, claiming that the Labour government will protect spaces for 'women' who she defines by some examples of how women are discriminated against. Honestly, this stuff turns people's brains to soup. You can't protect a group from discrimination if your only definition of the group is the discrimination they experience. Does she think the category of woman will cease to exist if we eliminate pay inequality and street harassment? Does a man who's underpaid get to go in the women's loos? She made herself sound an absolute idiot.

Labour's promise to protect single sex spaces is clearly completely worthless, since they only want to protect them against the men who don't want to come in anyway.
