DH: letter 6 Feb. Does letter capture decision panel had reached.

MR: Yes. We were in agreement.

DH: first and third allegations upheld, second wasn't. Why not?

MR: [that v careful speaking voice again] We felt that RA's evidence in meeting was compelling around how things would work in practice and we as board members couldn't know about that so we took on board RA's reasoning.

DH: Why did you apologise in outcome letter?

MR: It felt a long time to be in place of being investigated and in limbo. Lots of delays - weren't anybody's fault.

With respect, it seems several of those delays were eminently avoidable. E.g., hiring a transcription service would have been a negligible cost. Look at the costs they're incurring now.

They hired in legal advice but didn't even think to get in a transcription service?

The crux of it is that the advice suggested gross misconduct, and then when Roz questioned it, the advice suggested downgrading it to misconduct, and if asked why, suggested to say 'admin error'.

I'd love to know who these people giving 'advice' are. It was the same in the Forstater tribunal.

Oh that's interesting. I was wondering why RA was so extensively questioned by NC. Makes for a much longer hearing though.

Poor RA - I'm finding listening to this stressful (much more stressful than being misgendered, which has happened with non-English speakers before), I can only imagine how she's felt throughout this whole process.

I really hope the fact that they tried to gaslight Roz over the gross misconduct being just a admin error rather than them actually deciding that gross misconduct was correct then having to change it on further advice really shows the tribunal panel exactly what sort of shits they are!

Well, that is the whole thing about the whole case - lying being compulsory if it's policy... And not even asking if it's okay not to lie permitted...

NC: Worknest were giving advice. They are not all lawyers. Were you taking advice from HR person or lawyer.

MR: I believe a solicitor.

NC: Why wasn't transcript sent out to be professionally transcribed.

NC: Why didn't you just tell RA it's not gross misconduct and don't worry, that won't end your employment?

MR: I was following the advice I had been given.
