At some point after 2pm, in the Big Room (the Chamber).

www.parliament.scot/chamber-and-committees/whats-on-and-watch-live/whats-on#wm

Will be interesting to see how the Amendments go down, if they are all struck down as the ScotGov wishes - www.holyrood.com/news/view,gender-recognition-reform-crunch-vote-after-shona-robison-warns-msps-over-amendments

'the Scottish Conservatives have warned that the debate could lead to a "travesty of democracy" because a 15 minute time limit for each proposal will "shut down" discussion.'

Thank you so much for the updates. I can't get my head round this being both so utterly ridiculous, but simultaneously so serious.

ArabellaScott · 20/12/2022 17:50

If someone [police, I think] believes an application is fraudulent, they could apply to the Sherriff to have a GRC revoked

ResisterRex · 20/12/2022 17:52

Sex offenders will be required to notify police if they apply for a GRC

Sex offenders. Best known for telling the truth Hmm

ArabellaScott · 20/12/2022 17:53

Now discussing Sexual Risk Orders. How a GRC application could be paused based on police assessment.

Shona Robison - no evidence predatory/abusive men have ever needed to apply for a GRC - this hasn't happened in other countries where self ID has been adopted

No one on our side argues that predatory men have ever needed to claim to be women to access their victims. We are talking about what predatory males do.

Just as no predatory man has ever needed to become a priest, a teacher, a coach, social worker, a Samaritan or a Scout leader to access victims. But countless predatory men have done just that. And much, much more.

Which is why safeguarding takes a precautionary approach to all adults where children are concerned and all men where women are concerned. Not because all adults are predators, not because all men are predators, but because we have no way of distinguishing between those who are predators and those who aren't until after a victim has been harmed. Which is what we try to prevent with safeguarding measures.

This is not rocket science, it's risk management 101.

Birdsweepsin · 20/12/2022 17:57

Just imagine.... "Everyone needs to walk through the metal detector thingy in the airport, except trans people with a GRC"

Here let me help you with looping that hole

ArabellaScott · 20/12/2022 17:57

Now discussing EHRC compliance. Russell Findlay saying it all seems v slapdash.

OP posts:
ArabellaScott · 20/12/2022 17:58

Parliament doesn't look at legislative competence - that is for the govt.

Daniel Johnston - on what grounds are these not competent? Could Shona Robison explain how they fall foul of EHCR?

Right to private life/prohibition from discrimination - wtf are they talking about?

SR -I'm not a laywer, this is legal advice I'm given but not at liberty to share details of

[It seems govt lawyers give ministers advice on compliance and competence, but ITS ALL SECRET]

OP posts:
FusilliFettler · 20/12/2022 18:00

SR talking about risk. It’s just a tiny, tiny risk apparently.

Probably by Stonewalls lawyers. I’m not even joking.

ArabellaScott · 20/12/2022 18:02

SR is saying it's govt lawyers who advise on legal compliance. But who knows.

OP posts:
Whereareyourshoes · 20/12/2022 18:03

Oh if it’s a tiny risk we don’t need to worry about it. It’s all very clear. SR has had some advice from some people. Can’t share it.

FusilliFettler · 20/12/2022 18:03

I will never forgive these women for defending and allowing this law to be passed. Shame on all of you, especially you SR and MC.

FusilliFettler · 20/12/2022 18:05

MC defending the rights of rapists to get a GRC. That’s quite a look.

Whereareyourshoes · 20/12/2022 18:06

MC campaigning for the human rights of sex offenders. Trans rapists are rapists.

Birdsweepsin · 20/12/2022 18:06

Maggie Chapman just said trans people cannot possibly be sex offenders so we can't ask them to declare that they aren't, as part of their application for a GRC? Did I misunderstand that?

Rightsraptor · 20/12/2022 18:07

Is Maggie Chapman English? Sounds it.

So sorry about her, Scotland. Don't want her back though.

Whereareyourshoes · 20/12/2022 18:07

We could breach their human rights if we ask them if they are sex offenders?

ArabellaScott · 20/12/2022 18:08

She's African, I think. Can't recall which country.

Born in Zimbabwe/ Rhodesia I believe

ArabellaScott · 20/12/2022 18:09

Oh, I missed Maggie Chapman. What a shame.

OP posts:
CountZacular · 20/12/2022 18:09

I don't understand, even if it is just a tiny, tiny risk, what the issue is with agreeing the amendment. 'Genuine' trans women don't sexually assault, we are told, so it will mitigate against that tiny risk which is the point. It's not supposed affect trans women unless they actually are sex offenders.

CountZacular · 20/12/2022 18:11

Oh, ignore my last point then. So rapists right are human rights. More so than victim's rights. Doubly important if those rapists are, or say they are, trans then.
