I would possibly hazard a guess that if an application for security for costs was made it would include an estimate for what those costs would be and of course it would be served on the plaintiff who would need to know what costs they would be facing if they lost.

I couldn't possibly comment on the accuracy of the estimate that might have been used in such an application.....

IANAL and curious about something.

Say a serial vexatious litigant were to brag loudly on social media about how much money their vexatious litigation had cost one of their targets...

Does that not constitute evidence that they’re a vexatious litigant? Shouldn’t it be taken into consideration in the context of any other nuisance/harassment lawsuits they’ve filed?

Pombear - this thread is being very heavily moderated. I've had a deletion (but not a notification) for a thread I wrote mainly saying I was worried about Kate. Either it's an issue mentioning her surname (is it?? Hmm) or I was 'discourteous' about the main subject

I'm not sure a mumsnet would actually function if it were this heavily moderated ax the board..

Good Lord my first deletion. I feel quite proud. What on earth for? No deadnaming, expressing my personal, if low, opinion on someone who has made themselves a public figure of fun and an actual proper informed lawyer's opinion as to why it might have been more cost effective for Glinner to throw away £28k to settle now. What on earth breaches guidelines there?

That is great news about Glinner, but as others have also said I am worried about those who have been pursued who do not have Glinners means or profile?

How many women have quietly accepted a caution? How many women have ongoing proceedings hanging over them?

I am going to take the very unusual step of responding on here to save all the pointless speculation:

  1. There was no application for security for costs (indeed had there been one it could not succeed for various reasons which any lawyer with actual knowledge of civil procedure would understand).
  1. The Defendant's solicitors contacted me on 22 March 2019 asking to do a deal whereby I discontinued the case and agreed to go 50/50 on the Defendant's costs; i.e. they asked me to pay £14,000 (oddly enough 50% of £28,000).
  1. The Defendant asked for this deal AFTER he had been served witness evidence.
  1. I rejected the Defendant's "deal" and offered a counteroffer making clear that I was willing to 'drop hands' on the basis that the Defendant accepted responsibility for their own legal costs.
  1. I made clear that if my counteroffer was rejected I would be happy to continue the case. Further, it was also made clear that I had other priorities.
  1. On 25 March 2019 the Defendant accepted my counteroffer and the litigation was formally finalised on 27 March 2019 by a formal Consent Order.

A few points, anyone with any actual knowledge of how litigation works understands that 'drop hands' is used all the time and for many reasons. On any analysis the litigation cost this Defendant £28,000 (give or take the odd quid or two). The Defendant even paid the cost of finalising the Consent Order. Misgendering and dead naming is conduct that is more than capable of amounting to harassment (as the High Court as made clear in another case via injunction).

I am happy to announce that Stephanie Hayden has dropped the claim issued against me in October 2018 for libel, harassment and misuse of private information.

Hayden’s action caused my family unnecessary stress and financial strain and as far as I am concerned it should never have been brought.

The courts should not be used as a tool to silence discussion and debate.

If an individual is unable to understand very simple concepts like sex classes, I would be unconvinced by their claims to understand more complex things such as law.
