How often hetersexual men die during “risky” sex games because I can’t think of one case from the news? I know that sadly happens in same sex couples/ participants (can think of a couple examples from the news) but in hetero? It seems it tends to be women who love being throttled, punched, tied up, brutalised.

What does it mean he did not intend that to happen. What did he think would happen.

It’s surprising that his version of events was taken at face value, considering his previous convictions for crimes involving abuse of trust.

"He was "highly distressed" when he called 999 just after 9am, but lied to the emergency services, claiming she had “fallen on the knife”, then that she “rolled on the knife”.

"He made no comment on what happened in his three interviews with police".

"The court heard he has a number of previous convictions, including being jailed for 18 months in York in October 2016 for aggravated vehicle taking and theft.

He also has convictions for burglary, assault and threatening behaviour".

There was a similar case in Scotland recently with the sex game defence for the murder of a comparably young woman.

There was really no evidence of any ‘game’ as I could see in either case. It’s just straight murder.

What evidence is there of interest on her side?

Surely if these two people had been in any other non-sexual setting.. out to dinner, in the car, at work, doing a bit of DIY whatever.. and his specially kept knife for the purpose slashes her neck and she died as a result.... that would be taken really way more seriously than this and he would get more than a pathetic six years.

The take home message is that

  • the law is happy that consenting women will get whatever’s coming to them if they say yes to sex (way, way, way beyond anything they can consent to or to do with the sex act..Sad) on the basis that it’s a ‘consenting adults’ scenario Hmm so anything goes

-that men’s sexual preferences basically shouldn’t be restricted whether or not these are likely to (brutally, painfully,) actually end another person’s life. or just you know, ^make it extremely likely that a sexual ‘partner’ will die* if they act out whatever it is the man is into.

Ugh. What the hell is going on here?

Reminds me of another case a couple of years ago where a 16yr old was strangled during a sex game that she supposedly consented to. He was known to have done this previously although without fatal consequences.

12yrs for manslaughter-a travesty imo.

So he already had the knife under his pillow- it's not something they decided to use together. He has a history of violent behaviour and a young woman ended up dead in his bed. He then repeatedly lied or refused to co-operate with the investigation. But we are to take his word that these acts were consensual and just a 'sex game' gone wrong.

I wish judges would make far more of this aspect.

He'd done this repeatedly according to the report. But the logic seems to be that because no woman had died from it previously it was all fine and totally unexpected that any woman might ever die as a result of someone holding a knife tightly against their neck. Hmm

Did the police and the CPS actually believe this defence? Or did they charge down to get a conviction, any conviction?

I would dearly love sight of the charging discussions and decisions.

You know what it is Lang.? I read this, I read about that poor young woman who was trafficked and raped thousands of times, and wankers like our fledging misogynist, saying no one wants to be a feminist because there's no longer a need.

And I really don't have any words left.

All the expletives, the outrage the exclamation marks, sometimes seem to fall away.

Whilst on trial:
Claim to love the person and cry tears.

Get 6 years in prison, out in three if the appeals don't work.

Poor woman..

Porn has made choking etc mainstream, whether women want it or not. Now what people do in their own time in private as consenting adults is up to them BUT when acts like this become expected more widely this is one of the results.

The bus stop case was really chilling - the defence basically tried to say that she had a prior interest in choking and so naturally this was just sex gone wrong. how can that possibly be seen as a reasonable defence?

So you’re now seeing a situation where a man cuts a woman’s throat during sex and the defence is that ‘oh it’s just sex gone wrong.’ Again, how can that possibly be seen as reasonable? He had a knife under his pillow? She just rolled into it?

Now if you wake up in the middle of the night and someone is breaking into your home and you grab a knife from the kitchen in self defence that’s seen very differently to having a weapon in/by the bed, because the latter presumes you’re tooled up for violence. But having a knife under your pillow and using it during sex? Totally fine! 🤦🏻‍♀️

And let’s look at the weighting given to their histories.
He has a record of violent behaviour, confirmed by police and the courts.
She has no criminal record but apparently has had slightly edgy sex in the past.

So his real, documented history of violence is ignored but her alleged Non violent preferences mean he gets a light sentence.

Fuck. That. Shit.

Yes, words fail me. This has it all doesn’t it? Double standards, victim blaming, victim shaming, life being cheap... the lot. God it must be so frustrating being a copper and seeing all your work to bring people like this to court just dashed.

I dunno. This one seems to have been charged down to manslaughter - either because the CPS believed his defence or because CPS feared an acquittal on reasonable doubt grounds. And there are automatic discounts on sentences depending on the point at which a defendant pleads guilty.

Most US states seem to have offences of voluntary and involuntary manslaughter. This would likely have been involuntary based on the defence (murder requires premeditation; voluntary manslaughter requires intent to kill). Looking down the list of sentencing guidelines on Wiki (en.wikipedia.org/wiki/List_of_punishments_for_murder_in_the_United_States), it seems pretty much in line.

So if the case had turned out the same way stateside - the defence either believed by prosecution or feared strong enough to create reasonable doubt - it looks as though the sentence would have been similar in most states.
