I can’t see the will being legally enforceable. He can’t give away what he didn’t have when it was written.

Would have been much more interesting if the will had left everything to Suzie.

Oh god, I really hoped I was wrong about Alya! In real life, of course they would contest the will, but nobody ever does anything like that in soaps.

And yes, how ludicrously self-centred of Sophie to tell Johnny about that text. It was a total non-event, but he was guaranteed to react in the way he did.

Yes, I agree ZZZ, there's no way in the world she would have thought it was a good idea to tell him. They could have thought of something more likely to make him rage, Eva for example!

You can give away what you don't have and there are no grounds in law for this to be contested - EXCEPT possibly by Suzie, but no-one knows she is his baby so no-one will bring the claim.......

Re giving away what you don't have "I leave all my worldly possessions to x", tomorrow I get given a house, the house is included in 'worldly possessions', thus it goes to x.
If the will says "I leave my share of the factory to Aliyah" then, again, it goes to her.

If he says "I leave x number of shares in the factory to Alyiah" then she gets x number of shares and the rest fall to residue (which is the bit where you say "and everything else to....y"). If 'residue' has not been bequeathed anywhere then that section will fall to intestacy rules.

If any falls to intestacy, then it all goes to Johnny (is there a mother, I can't recall) though it would go to Suzie if anyone knew......

And, if it does all go to Aliah (no idea how to spell her name, sorry) Suzie could contest as she could claim she has a 'reasonable expectation of financial support' - though this would be pretty difficult to prove as her mother has given her away and had no intention of telling Aiden of her existence, and she will be supported by her new family.

I think Michelle will tear up the will, pretend she never saw it, and it will all go to Johnny and then Eva will make the claim on behalf of Suzie (and take her back) which Johnny will be happy to allow, and then Eva will leave with the baby (who will come back in x years and wreak havoc, of course).

Mind you, soaps are not known for bothering with actual law :)

I was annoyed at first when Michelle hid the will- classic soapland, constant lies and secrecy. But now i wish she'd binned it!

I really hope Alyah doesn't get to have the factory. She is a really annoying character and comes across as not as business savvy as she thinks she is. Surely it should be based on the share he owned when he wrote the will, but maybe not.

It'll be more friction for Kate and Zidane too when they take sides

But what he left was specific, not ‘all his worldly goods’. So surely the will would state: ‘I leave my share in the factory’ not ‘I leave the factory’, as he didn’t own it then.

The writers have weakened his character a bit I think, because no way would he overlook his will following Carla’s gifting the shares, knowing that he’s taking his own life. It paints him in a character contrary to the Aiden on the street.

Very odd about the will - Aiden was meticulous about planning his suicide, seeing everyone, passing on his belongings, saying 'goodbye' cryptically, leaving a note - there's no way he would have overlooked his will. He'd have reviewed it and changed it, he would surely have left factory to Carla (or at least family). Perhaps there's a newer one?

But "my share in the factory" was, at the time of his death, total ownership, OyO. So it should all got to Alya?

If Michelle does destroy/hide the will, wouldn't the Johnny and Kate inherit?

Why would they look for a photo in his flat? Why would he have one of himself? Why not just ask his friends or look on facebook?

From CAB on intestacy in England:

"Children - if there is no surviving married or civil partner

'If there is no surviving partner, the children of a person who has died without leaving a will inherit the whole estate. This applies however much the estate is worth. If there are two or more children, the estate will be divided equally between them".

So if paternity of Susie were established before the estate was distributed, she'd get the lot, but it would be held in trust until she was 18.

If not, "Parents, brothers and sisters and nieces and nephews of the intestate person may inherit under the rules of intestacy. This will depend on a number of circumstances"

So if Michelle destroys the Will, and Susie's paternity is established, then S inherits via intestactpy as his only child, factory is out in trust for her - with Carla (and/or Johnny, but prefer Carla for this because of added piquancy for Peter) appointed trustee/factory boss until S is old enough to take charge of her own affairs.

Who has paper photos? Or at least recent ones? Everyone has their photos on their phone. Kate surely would have loads of photos of him on hers.
