I don't understand why someone didn't just send Ben a text saying "hide" unless they thought it'd be found and used as evidence.

Although I wonder what evidence the police actually have on him. Considering Jay was with him when they "mugged" Lucy, the witness would have seen them both.

Wish they'd just left this storyline alone since the big reveal.

So Max is Jay now? That 'witness' was a bloody joke. Plus I'm sure I've read court cases where discrepancies in the police paper work have meant the whole thing has been thrown out so the cops doing that identification thing and questioning Ben when they shouldn't be means it would be he thrown out anyway.

Yes, the police seem remarkably cavalier about the fact that any good lawyer could get that case thrown out on any one of the millions of ways they violated procedure: questioning Ben when he had asked for his lawyer just for a start.
