Clause 2.2 says

' Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery'.

The man on the phone actually said that the contract is formed when the items leave their hands and go to delivery people. Think I said that in previous post but just wanted to make sure it was clear.

have taken delivery of a drawer.

on the understanding that a bed would be arriving on later delivery.

wrote a note explaining this on signing sheet.

phoned to enquire when rest of bed will be arriving.

was told that ts it, only a drawer.

i said "i have an email confirming i'm getting a bed and have spoken to 3 people who have confirmed it is a bed. i want a bed."

much muttering and spoke to team leader.

advised to send paper copy of confirmation email to customer services dept to resolve issue.

end of call.

am actually really .

they made an invitation to treat - a bed for £30.

i offered my £30 for it.

they accepted and took my dosh.

i have my paperwork saying it is a bed.

i accepted the drawer in good faith that rest of bed would follow.

misrepresentation me thinks?

should i ring them back and argue some more?

so now we know that as long as the "bed" is being shown as received at depot the contract has been formed and so they have to honour it.

i don't think dropdeadfred rang them to argue the toss though. if they think they can get away with not honouring it they're going to try.

Mine was shown as being at depot then they cancelled it - the customer service rep couln't see why on her screen so gave me the depot number. they said that Aditions had emailed them telling them to cancel the delivery. I did ring Additions back and they passed me through to someone senior but they said that I was not going to get the bed...unless I wante dto reorder at £159.... to be honest I didn't argue that much just told them it was shoddy and I wanted a credit sooner than the 14 days they quoted me!!

The delivery people told DH that the bed would follow and he refused to accept it.

it came and it went again it was a storage drawer.my husband was here when it came and told them it wasn't what was ordered.he said they weren't very pleased at having to take it back and literally threw it in the van.i wonder how many wasted trips they'll have delivering drawers.i rang additions and they said it'll go back to depot as refused delivery and money will be put back onto card.i'm off for a lie down now on my old but comfy bed !

when they ring me back to arrange delivery for wed i am going to make them check that the bed stead will be delivered as my firned ordered the same bed and just a drwaer turned up.....

It may be worth asking them if they would post you a cheque straight out as a refund - to avoid the ongoing problems I've now had for a month with them crediting (or not!) back to card.
