Then, if you read through these Parliamentary committee meeting “Oral Evidence” transcripts with legal experts discussing why self -ID GRCs would cause problems in their interaction with the Equality Act, following the Scottish Parliament’s decision, and following Lady Haldane’s judgement in the For Women Scotland ruling, you’ll actually see there are disagreements over what sex means in the Equality Act, but agreement that it needs to be made clear that sex means biological sex, not ‘legal’ GRC sex.

In practice Gender Reassignment has also lead to organisations and associations fearing to discriminate against people with that Equality Act characteristic in order to provide single sex spaces.

Because pace Lady Hale's judgement in the Court of Inner Session back in December, there is clearly a need to make it explicit that sex means biological sex. It was clearly understood by Westminster that that was the intention when the Eq2010 passed and so didn't need spelling out at that time. Unfortunately, what was common sense a couple of decades ago is heresy now - hence the need for clarity today.

What needs clarifying?

That sex in the Equality Act, is biological sex not “sex as modified by a gender recognition certificate”.

(No surgery necessary is necessary for a man to become a woman in law. Likewise, no surgery is required to attain one of the EA characteristics, Gender Reassignment so 🍆+💄is enough to make a woman.)

Without this clarification many organisations and associations fear discrimination litigation if they discriminate against men who identify as women, some of whom “legally” are woman with “sex female” written on their birth certificates.

So they will not actually provide [biological] sex based spaces even though they are theoretically allowed under the Equality Act.
