here is Part 5 but we are ready (nearly) for a new one.

Who on earth is frank? Was he there on the night reeva was killed?

LookingThroughTheFog · 05/05/2014 16:09

Re the timing of Aimee's arriving, the witness said she'd gone home to shower and change, and come back, and she Aimee was there then. I think it was Nel who clarified 'much later' and she said yes, and he said 'the sun was shining' and she said yes.

So not during the flurry of night activity.

Hillwalker · 05/05/2014 16:11

Frank is OP 's live-in servant who, we now discover, was in the house that night but neither heard nor saw anything.

Shock unbelievable

After catching up on the threads this morning I think it is a clear example of how unreliable ear witness testimony is. We hear something and then moments later we are already somewhat cloudy on what we heard. Mrs Stipp was very confident on what she heard that night but she missed a shot and said she saw a man in the window and then didn't see a man in the window. She was confident she was not in the room when the pictures were taken of her bedroom and Mr Oldwage showed it was her hand holding the curtains back in a picture by the bracelet she was wearing. Some thought it was odd Miss Stander stayed in bed and covered her head. Michelle Berger gave her dramatic testimony but if I heard her correctly she never got out of bed, after fumbling with several security numbers gave up. After thinking a lady just witnessed her husband being murdered she went back to bed and woke up next morning at normal time. She testified she was traumatized by the whole thing but was able to fall back asleep after the whole thing. People react and interpret things in so many different ways. If it is not how we interpret the situation then it is seems odd or wrong to us.

Thanks Looking, I have only been able to read a summary today which didn't include those details.

RonaldMcDonald · 05/05/2014 16:32

Frank will not have been in the house
He will live in small accommodation in the garden or in an outhouse type thing
Not in the house but within the perimeter

Roussette · 05/05/2014 16:37

YNK, can I ask who AO is? I should know I'm sure but have missed something.

Knowing what happened (if not the intent) I as the victim's mother would want no one but police touching my dead daughter's handbag. I don't think of it as a conspiracy as such. Just crass. Possibly done with good intentions maybe but not right.

As for Frank, I am absolutely gobsmacked. Can't witnesses or people be subpoeonad or whatever it's called and have to testify?

Hillwalker · 05/05/2014 16:37

Still closer than anybody else, Ronald.

RonaldMcDonald · 05/05/2014 16:41

Yes he is closest but I will be amazed if any staff come forward to testify in any great detail
Utterly not worth their while

Hillwalker · 05/05/2014 16:43

No subpoenas in SA?

LookingThroughTheFog · 05/05/2014 16:43

can I ask who AO is?

Not wishing to speak for YNK, but I believe this was a mistype, and it refers to Aimee.

AmIthatSpringy · 05/05/2014 16:43

Frankie lives in a seperate building in the garden. According to barry Bateman his statement didn't say much. But we don't actually know what it said , just Barry's tweet "summary"

RonaldMcDonald · 05/05/2014 16:44

Am I right in thinking that they didn't pack the bag there and then for OP?

I was mystified by this bit of testimony

Did they go shower come back and pack a bag or do it as first testified?

I am taking meds so forgive my fuzzy head

RonaldMcDonald · 05/05/2014 16:46

If Frankie has given evidence that he heard nothing there seems little point pursuing him
He would just say the same on the stand and both P and D want to demonstrate screaming shouting etc
He'd add nothing

StampyIsMyBoyfriend · 05/05/2014 16:56

Marking place until small boy is in bed

YNK · 05/05/2014 16:56

Thanks Looking, yes a typo, Should have been AP - Aimee Pistorius, sorry

LookingThroughTheFog · 05/05/2014 17:03

Did they go shower come back and pack a bag or do it as first testified?

That's my understanding, Ronald. Today's witness (I'm rubbish with names) left to change and shower. She then returned later in the morning to the house. She saw Aimee through the top window, looking distressed, and asked if she could go and help her, and was allowed.

She went up to help Aimee pack a bag for Oscar, and was accompanied by an officer all the time she was in the bedroom. She left the other two to go into the spare room to get a bag, but other than that, was in the company of Aimee and the officer throughout.

This is when I then get confused. They go downstairs, and I can't tell whether they left the house. I think she said they did, and I think she said that they then discussed whether to take Reeva's handbag, which was still on the kitchen counter where it had been left after Oscar got the ID. They, or Aimee, decided that they would take the bag, so she went back to get it.

I suppose it will be interesting whether Aimee testifies and says whether she took it under the noses of police, and whether they were challenged or not.

YNK · 05/05/2014 17:05

Yes Ronald I am surprised too, if they held OP in bloodsoaked clothing, waiting for his sister to fetch him clothes in the morning.

It also surprises me that with all the security they were paying for, people do not seem to have given much store by keeping the correct numbers stored on their phones.

YNK · 05/05/2014 17:11

Can anyone clarify for me if indeed the paramedics asked for the id?
As I understand OP went upstairs twice on his own, once before and once after the emergency services arrived.
The second time CS (CV) went up and waited for him outside the bedroom door and heard his footsteps on the tiled floor. She had to call him to hurry up because they were worried (since the gun was still there)

RonaldMcDonald · 05/05/2014 17:14

The worst part of today was trying to show that Silverwoods estate wasn't a safe place to live
Masipa's face when Nel was clarifying that the break ins ( non ending in death or severe violence ) had happened 3/4 years previously and that they had improved security even more since then

The Standers also all slept with their balcony windows open ( something we'd NEVER do )
As did most of the estate by the sounds of things
No one had burglar bars ( remember OP said in his Bail Statement how he'd thought an intruder had gotten in through the bathroom window as it didn't have burglar bars fitted ...no window had burglar bars fitted )

Astonishingly low level of crime for a housing estate anywhere in the world

voiceofgodot · 05/05/2014 17:21

I find it shocking that Frank has not provided a statement of any note. I mean, I can understand it in terms of the difficulty it would pose. But the water feature excuse is ludicrous, clearly.

AmIthatSpringy · 05/05/2014 17:32

Voice Do you know where the water feature was used as an excuse. Did barry Bateman tweet that too.

I have heard it mentioned before but the water feature in his garden is quite peaceful looking.

I've seen OP interviewed beside it and it has been tinkly rather than torrential

YNK · 05/05/2014 17:56

OP didn't bother checking if the alarm beacons were even on the wall outside, or if the ladders were put away, or fix a broken downstairs window yet he kept a gun loaded with deadly bullets and a cricket bat near his bed?
Especially when guns have a habit of just going off in his hands.

YNK · 05/05/2014 18:01

Carice : “I settled back in under the covers with the dogs… I was lying in bed thinking, oh my gosh how am I going to sleep now because that the voice I heard, I know for a… sounds to me it’s a man’s voice… I could hear a man shouting meaning that there must be terrible trouble because then where is the lady ?

How did she know there was a lady?
