Dont really know what to say its all very calm but shes defiant and is given several chances to move

I dont doubt she was being an ass. She was.

There are plenty of threads about police being over zealous in other areas.

I could bore you with how I havent left my house for six weeks.

My point being, the police aren't sure on their meeting powers and it will be abused.

For the last five years, we have been telling people to talk about mental health. Here we have a woman sitting in a park, on a bench, doing mental exercise and MN are supporting her to be tasered, criminally charged, she is 'mental'

I'm not saying she was right in her approach. She wasnt.

It is revealing though, that people are praying for her. That tells me so much more about people than it does her being a dick.

The blog references upthread is irrelevant to this issue, because Marie Dinou was incorrectly charged under schedule 21 of the Coronavirus Act 2020 which gives the right for the police to detain potentially infectious people. The notice issued to this woman will have been under the Health Protection Regulations 2020, the relevant bit of which says:

6.—(1) During the emergency period, no person may leave the place where they are living without reasonable excuse.

(2) For the purposes of paragraph (1), a reasonable excuse includes the need—

(b) to take exercise either alone or with other members of their household.

Given that this relates to a reasonable excuse for leaving the house, that it is perfectly clear that the Regulations acknowledge our need for physical exercise which very few people can get indoors, and that you don't have to leave any house in order to take mental exercise - it's looking highly likely that the police acted perfectly properly in this case.

Indeed, But that is not what a judge would be doing in this case. The judge would be applying the law, in exactly the same way hundreds of judges do every day all over the country.

That's the key word. That's where the law is flaky. I think that's what we call a loophole.

No, it isn't, because there is nothing in the law saying that people have to be "around" you for you to be out of doors without reasonable excuse.

'Around' is not a loophole. It's guidance. There is no time limit in the Regulations on the amount of time that you can spend exercising (or the number of times a day that you can go out to exercise or for other valid reasons).

It seems unlikely that anyone would be stopped for having too long a walk or bike ride, not least because no one is likely to notice if you keep moving.

The police had not asked her to move on an hour before. The officer stated they had seen her 45 minutes before.

I don't disagree that she has been out of order. But I do and will argue that there is a case for mental health in that mental health exercise COULD well be a mitigating factor in her defence.

If the government don’t think lockdown has been effective at reducing the amount of infections and delaying the peak, they will look at imposing a harsher lockdown to prevent more deaths.

Drinking alcohol and smoking cigarettes for an hour on a park bench (and she intended to stay for at least 2 hours) is not what the exercise exemption intended to permit. She took the piss and others will suffer as a result of her actions.

On a positive note she has definitively illustrated the often misunderstood fact that speaking in a RP accent does not automatically mean you are clever. It is a sad truth that many people think that having a RP accent does correlate to having increased mental acuity., and of course the inverse, that having a nonRP accent means you are as thick as shit. Fortunately this argumentative, time wasting, oxygen thief has proved once and for all that intelligence has nothing to do with oral fluency,and or accent accent.

There were people sat on those benches again today and on the grass behind it. Richmond is a beautiful place to live and most people seem to just be walking or riding at a distance but a select few just acting like it’s a normal summer and sitting about.
I’ve only been out for about three walks that were for the purpose of exercise not shopping and I beer between feeling really uncomfortable then settling and enjoying the walk and then thinking oh god am I not being careful enough about walking to close to people. I had more luck just wandering around local streets in the evening that heading wandering around that area in the day.

Ah the rubbish school teacher way to enforce rules punish the whole class for one person's actions.

Most people are following the rules so you go after the ones who aren't as they did in this situation. If you punish everyone it will cause resentment which won't help the government or the police .
