I’m really tempted to apply for carers allowance as weekly is great and it seems UC are just taking their time? If they take some back I think we will still be owed some from UC as applied for caters and disabled child element x

@Mummyrach13 i think that means the monetary value, no more than 3 months worth of backpay. I have been awarded from 12/07 when my boys dla was awarded xx

Here’s what you’ll need to do in regards to UC. Unfortunately, there’s no time scale on how long the backpay will take to be approved. Once you get the letter clarifying how much the amount is then the payment will only take 3-5 working days from then.

@Sskanf hope the screenshots help. You can claim the disabled child element regardless of what the award is and you can claim the carer element (so not carers allowance) if your child was awarded MRC or HRC

We were awarded from 10/6 I seen on fb that they backdate if you let them know within 28 days of decision but I’m not sure x

Got through after 1 hr 30 to a Tom who checked for me said taking around 18 weeks as they are busier than normal, said should go to dm next week 💀 scan date 20/07

@Jude82 yes I agree. I think they are all over the place! I'm in Yorkshire. Not seen anyone from my area be awarded around my date so I'm going to assume I have another week or so. I'm going to ring next week though to see what's happening. Good luck!! Hope it's good news for you.

With DM from Monday 06/11 (17 weeks + 4 days)

Call from DM Friday 10/11 for clarification on some info.

Decision made 10/11 (but not told on the phone)

Letter recevied today 16/11

So from start to finish 18 weeks + 1 day.

DLA higher, Mobility lower.

Backdated to 06/07

Money in 15/11 (yesterday)

I sent a lot of information too.

Now I need to reapply for carers to be backdated.

@Asdmummyhere do you have to get the carers allowance backdated!? Or could you just apply and out today's date so your not going to owe loads to uc? I'd rather not owe loads but weekly money sounds so much more manageable xxx

I’m hoping someone may be able to answer my question, I’m really confused after calling dla because I’m new to all meeting regarding my sons needs, so I’m waiting for a report from the educational psychologist ( First meeting ) and I asked if I would still have time to send it in and he said to send it in as even if they made there decision they would review it again once receiving his educational psychologist report so he’s put that on the system to say that I’m waiting for it and will send it in once I receive it but he said about changing it to say my son has a care plan in place if he’s seeing the educational psychologist but I didn’t know if that meeting means he has a care plan in place? Does anyone know?

Just got off the phone, my LB has been awarded MRC, LRM, im so upset because it should be HRC, he is in a specialist school, non verbal, no understanding or danger awareness or coordination and has to be supervised at all times day and night as doesn't sleep well at all, needs help to be fed, dressing in pads as cannot toilet. What do I need to do to appeal this I am really upset that I have to go through this process. Xox

@Sskanf @Rebeccanew got through to a lovely lady called June (was on hold for an hour and 10 mins) Told me my claim is still with a Decision maker and "she" will send me a text. Apparently my evidence has still not been scanned on so awaiting this. She went quite heavily into the MR process with me without me even asking. Told me if i get a decline to call in straightaway and start the MR process over the phone and it will be dealt with within 2 weeks and by a different DM too. This is NEVER ENDING really not hopefull at all not calling again EVER lol xx

@Mojo161989 In so sorry the right rate has not been awarded for your son. I would request a MR and also look at advice on disabilityrightsuk.org. It outlines on there exactly what qualifies for HRC and if you feel that describes your son then I’d suggest you outline that again in the MR with clear examples of how and maybe make a diary of his daily needs showing that he does meet that standard of care and so he does qualify for HRC and not MRC. I know you likely feel you explained all of this in the original claim and so it’s a bit like repeating yourself and so frustrating but the DM has made an incorrect assumption somewhere by the sounds of it. In the meantime you have some DLA now to helpfully help as I’ve heard it can be 4-11 weeks for MR. Good luck and stay positive x

The difference between MRC and HRC is that your child will need care and supervision frequently throughout the day and night. MRC does cover night needs too.

Were you able to send in a sleep diary or any professional reports that confirms your DS needs frequent care during the night AND day? That’s what DWP are looking for in order to award HRC.

To challenge the award, let them know that you’d like to do a MR and ask them for the letter of reasons as to why the specific awards have been given. That way you can see the breakdown. Just remember that with a MR, it goes to a different DM and the whole claim is looked at all together. They can increase the award, decrease it or take it away all together. You may want to gather evidence for the renewal so that you don’t risk the award but if you’re confident DS should have got HRC, fight it all the way! Good luck🤞🏾
