AIBU to think these boys should have been incarcerated?

I've never started an AIBU before, but I'm genuinely really shocked. I'm just not sure how this sentence is justifiable. Their actions were premeditated and deliberate, they were carrying a knife and they filmed themselves. They're obviously a danger to women/girls, and probably to other boys too.

If anyone knows how and why this sentence might have come about, I'd be interested to hear it.

Speaking as a civil servant you can bet your life @FinchiePinkthat receipt of 30k forms in relation to one offence will absolutely be flagged up to the AG and the Justice Minister. As politicians they absolutely want to be informed when vast numbers of the public are unhappy.

I don't get this train of thought though, if we can try 10 year olds for murder and lock them up then why would a 13/14 year old not be locked up for a premeditated gang rape & filming it?

The Court found they were fit for trial in any event. Given the low level of capacity I did wonder how.

Fair enough, but even so, what the hell do we do with men like these?

It is things like this that would lead me to consider taking action myself if this was to ever happen to my daughter. The thought of having to wait years for it to get to court, for a judge to do this 😱
I wonder if he'd have felt differently if it was his wife, daughter, or himself, who had been put through this ordeal. Sickening.

Because each case is judged on its own merits. We don't know what - if any, beyond age - mitigating factors may be in play regarding these boys. And we won't know until (or if) we get the sentencing remarks.

Though we do know:

the attack was planned

the girls were raped

the rape was filmed

film of the attack was uploaded to social media

a knife was used as part of the intimidation

I am struggling to think of any mitigating circumstances that would be strong enough to warrant those actions being ignored in favour of a non custodial sentence.

Just say names not reported due to reporting restrictions due to age.

These boys have probably ROBBED these girls of experiencing Falling in Love for the first time and getting innocently married.
These girls probably will have psychological serious trauma symptoms including Panic episodes, PTSD which will last for years and could need intense therapy for a long time.
As for the boys , they probably just went home, had a Shower, change of underpants, and life carrying on as normal; until they get bored again abd find another lone girl to r @ p e.

What?? Why does being a victim of violence prevent you from getting married or falling n love or being happy? Yes the girls will be harmed by what has happened and it will have lifelong consequences, but we don’t need to condemn them to never having any good things in their lives, jeez.

I’ve filled the form in too. I work in Criminal Justice and I despair at the pathetic lenient sentences I see on the daily, or people being given bail after bail. The males I see are getting younger and genuinely don’t give a fuck as they know nothing serious will happen to them. No deterrent at all.

Do what I did and just put that they are legally too young to be named. I think they’ll work out who you’re referring to!

Completely agree. There are no mitigating circumstances that mean these teenagers don’t deserve time behind bars. And I’m generally quite liberal when it comes to things like this.

I've also submitted the form.
This is local to me and I have a DD, it's an absolute disgrace. I also think the sentencing guidelines need review. This was planned, filmed and shared on the Internet, all aggravating factors!
