Bloody parking charge

RoseWrites · 26/01/2023 14:41

I went to a car park and my 4 year old went batshit on the way in. I quickly parked and got her out and calmed her down. I looked at the car, and one wheel was on the white line. Tbh I couldn't be bothered with putting DD back and reparking so I just dashed into the shop. Came out 5 minutes later and found a ticket on my car for £100.
I got home and appealed it but got a standard letter back saying appeal has been denied, but with no rationale. I assume they send the same wording to everyone. There's no way of contacting them.
My options are pay for the fine now or appeal to the ombudsman but run the risk of paying more if that's denied.
If it's any use, it's Excel parking. And the car park is in cramlington.
Would you appeal or just (begrudgingly) pay?

Pot kettle black 😂 you're wrong in your earlier posts but refuse to accept it.

I stand by everything I said. She doesn't need to pay right now because she can dispute it.

And I don't need, nor care for you to agree with me.

You dont need to care about whether you are giving good advice or not either because if you are wrong you dont get a fine.
Its up to you OP, fight it (no idea on what grounds) and risk having to pay a lot more or take the advice from the grownups and pay and move on.

Quornflakegirl · 27/01/2023 13:49

They fine no matter the situation. When dtwins were weeks old I had to take them back to hospital for hip scans. I had had a C-section and the more abdominal surgery a month later so it was difficult for me to bend and move. I deliberately took up two spaces as I couldn’t get both babies out the car or bend and twist, came back to a fine and they didn’t care at all when I told them why I had parked this way. There were no bigger bays so I had no choice. I paid, wasn’t happy but I paid.

Loving the troll arguing with the actual lawyer.

How do we know that anyone is who they claim to be on here?

To the op my advice is to go to this forum as there are people who know what they're talking about there. Unlike MN.

Advice has changed on what to do about parking tickets but you can challenge a fine which is disproportionate.

True, we don’t know

but if I were a betting man, I’d say one poster claims to be and cones across as that might well be the case.

the other comes across like a knob

You have defends against a car park. Firstly we’ll done, I’m can see you’re very proud

secondly, you may have defended on totally different facts. You’re not saying, so to confidently state a different person in different circumstances also doesn’t have to pay is, well, daft.

thirdly, claiming superiority of intellect and ability due to this sun is even dafter

If anything "i'M a LaWyEr" is more of an attempt to assert superiority.

I'm just standing by my view, it's a dependable claim.

OP isn't held at gun point being forced to adopt my view. They can do as they please.

I don't understand why people expect absolute concensus on an open forum. So strange

I didn’t mention my job until it became directly relevant when you decided to throw a bitch fit and accuse me of not having the brains to go to court to dispute a parking claim. Which, frankly, requires the ability to fill out a form, with help…

Plenty of people with no legal training have said you’re wrong too, it’s not a professional insight that you’re wrong here. It’s just proof that I definitely have the “brains” to dispute a parking ticket

Elsiebear90 · 27/01/2023 13:55

I always google the company and see if they’ve ever taken anyone to court, if they haven’t then I ignore. I’ve had quite a few fines over the past ten years or so and I only ever challenged two (and won) because they were from parkingeye and they definitely do take people to court, the rest I ignored and nothing has come of it.

BabyOnBoard90 · 27/01/2023 13:55

Chickenly · 27/01/2023 13:47

It’s not about what I agree with FFS. It’s about m you giving the OP incorrect advice and then trying to backtrack and change the advice as if we can’t all scroll back and see what you originally wrote. My advice hasn’t changed.

I'm not changing anything, I've stood by what I said.

You could just simply give your allegedly more valid advice and let the OP make up their mind?

But if you have unlimited time at your hands, then do continue debating every post you deem to be incorrect across the forums.

SlashBeef · 27/01/2023 13:56

You couldn't be arsed so it cost you £100 🤷‍♀️

It can be disputed. They are unlikely to take her to court for £100. If they do, more than likely she can win.

I'm not changing my position here. You could be the AG, my position is clear and shiftable. Make peace with that

BabyOnBoard90 · 27/01/2023 14:00

Unshiftable*

More than likely she’d win?

based on what?

Most people beat private parking companies in court. But don't need to take my word for it, look it up

Most people don’t go to court without a case of any kind.

Doubling, tripling and quadrupling down on being wrong doesn’t make you sound smarter than others.

Nor does personally attacking people because they called you out or demonstrated that you’re wrong.

Most companies aren't going to spend hundreds on legal fees to pursue £100.

Can't see where I've personally attacked anyone. If anything I'm the one being attacked tbh

How much was your parking fine for then?

So, based on other people’s cases and facts?

what specifically about the op’s facts lead you to state she’d more than likely win?

What specifically suggests she would lose in court or even get taken to court?

Right nothing but speculation. I've given my view, OP can do as she pleases.

just say you couldn't do it and move on. Don't be a hater just cause someone else has the brains to combat what you cannot

You can’t read that? Come off it. You’ve been rude to people from start to finish.

Multiple fines totalling several hundred more, so it was worth ECP taking a gamble and bringing me to court.

You think my post is rude and not post I was replying to? Yeah that makes sense

Lenald · 27/01/2023 14:14

One wheel was on the white line? That’s allowed, if it wasn’t over, appeal it. They should have photos.
