Bloody parking charge

I went to a car park and my 4 year old went batshit on the way in. I quickly parked and got her out and calmed her down. I looked at the car, and one wheel was on the white line. Tbh I couldn't be bothered with putting DD back and reparking so I just dashed into the shop. Came out 5 minutes later and found a ticket on my car for £100.
I got home and appealed it but got a standard letter back saying appeal has been denied, but with no rationale. I assume they send the same wording to everyone. There's no way of contacting them.
My options are pay for the fine now or appeal to the ombudsman but run the risk of paying more if that's denied.
If it's any use, it's Excel parking. And the car park is in cramlington.
Would you appeal or just (begrudgingly) pay?

It doesn’t need to. It shows that refusing to pay can be successful.

Refusing to go to hospital when you’re in labour can work out fine too - it doesn’t mean it’s good advice. Refusing to drive slowly in a snow storm might still mean you get to your destination without crashing, it doesn’t mean that it’s a good course of action.

Of course sometimes people do stupid things and it turns out fine for them but that doesn’t change the fact that it would be stupid for OP to try and fight this because she’s absolutely nailed on it. It’s vastly more likely that she’s end up paying more rather than less. The only reason OP’s fine would be dismissed is if they fucked up and didn’t get the evidence that they should have got or displayed appropriate signage. It doesn’t matter how smart or sneaky OP is, she’s relying on them messing up in order to avoid the fine and she (nor you) can’t know that they have (and they probably haven’t).

You pay because you were in the live and knew it. Parking that way could prevent someone else from being able to park in the space next to you. Be more careful next time.

I think it would depend on the rules of the car park - harsh though but I guess they don't know / care if it was 5 mins or 5 hours

No, I work in international disputes for a global elite firm. My “expertise” isn’t in something that’s covered in first year contract law because it’s, frankly, not a situation you can be an expert in because it’s incredibly basic. OP is liable to pay this fine based upon everything she’s outlined, advising her not to pay it will simply result in her owing them even more. You have bad, incorrect, out of date advice. And, since then, you’ve come across very poorly too.

Listing your accolades doesn't reinforce your point or qualification in this area, you could be a supreme court judge for all I care.

There is absolutely nothing incorrect by advising that this claim can be disputed.

But it is absolutely incorrect to say that OP
doesn’t need to pay it. Which is what you actually said. You can dispute absolutely anything you like, no one said you can’t - just that it would almost certainly result in OP having to pay more than if she just paid it.

Euro car parks are the worst. Have appealed and won a couple of times with these.

Disputing it doesn’t mean you don’t have to pay it. If you dispute it and lose then you have to pay it and you have to pay fees on top. Disputing it just means you’re asking for someone else to decide whether or not you actually have to pay it.

There’s a small chance a technicality not mentioned in the OP means she doesn’t need to but, in all likelihood, she has to pay. You were, entirely and completely and totally wrong to say she definitely doesn’t need to pay it. You’re probably wrong to say she doesn’t need to. It’s bad advice to advise her to dispute it when she has no grounds for a dispute.

Your second paragraph doesn’t make sense. I have no idea what you’re trying to say. I understand it’s an attempt at an insult though so good job on that one.

Euro Car Parks are utter cunts. MIL took the entire extended family for a meal at a pub where the car park was "managed" by Euro Car Parks. We entered the reg no into the terminal in the pub, as required and got a ticket about 3 weeks later.

The saga rambled on and on, they pub kept telling them we were customers and shouldn't have to pay, so did we, but the letters demanding money kept on coming and the amount they were demanding kept going up. I can't remember how it got sorted in the end.

Most of these private parking companies are utter shits.

Worth reading the sign in the car park OP, and seeing what it says about the lines. I think on the line for on-street parking is acceptable, but that doesn't necessarily mean that the same applies to private ones.

This is what life is like in the UK these days. A ridiculously minor infringement for 5 mins that harmed and inconvenienced nobody is made into a fine of £££ by a private company who has employees just watching and waiting for a ridiculous reason to make £££. Shameful. Having said that, I’d pay to make the problem go away and get on with your life. The UK is really a shitty place these days.

Usually these ‘5 minutes’ and ‘minor infringements’ are not the truth though🙄

All you have is a load of waffle. For such a high profile successful lawyer (albeit there's no evidence of this) you would think you would allocate more time on your cases than disputing a parking charge with strangers on the Internet.

OP you can dispute the case if you want. It's very straightforward and there are forums that can help you if you provide all the useful details.

secondly, you may have defended on totally different facts. You’re not saying, so to confidently state a different person in different circumstances also doesn’t have to pay is, well, daft.

£100 is not a reasonable amount of money to fine someone because you had your tyre on and not over a line.

They can't legally fine you any amount of money just because it suits them. And that's what you should be challenging.

How do we know that anyone is who they claim to be on here?

To the op my advice is to go to this forum as there are people who know what they're talking about there. Unlike MN.

Advice has changed on what to do about parking tickets but you can challenge a fine which is disproportionate.

It’s not about what I agree with FFS. It’s about m you giving the OP incorrect advice and then trying to backtrack and change the advice as if we can’t all scroll back and see what you originally wrote. My advice hasn’t changed.
