There may be what the court has termed testimonial qualities of the act of producing documents, but the documents themselves are not protected by the 5th Amendment.

An example would be: Prosecuting counsel enters into evidence in a bribery trial a cheque written to the defendant as a bribe. The cheque was submitted (via subpoena) by a witness. Counsel asks this witness "Did you write this cheque?". Witness answers "I take the Fifth". The cheque remains in evidence as evidence of a bribe, but the witness does not have to answer, nor can he be punished for not answering, the question.

(Witness can still be brought up on charges for offering a bribe but that would be a separate matter)

I'm OK with the redactions in the Flynn doc. I'm sure it'll all come out eventually and I'd rather not give the subject of the redactions (cough, Scrotus, cough) any info about what's coming .

Whether or not I'm OK with the 'no jail time' will depend on what happens Scrotus gets his ass handed to him at the end.

Probably not part of Mueller's thinking at all but no jail time may stop any exhausting, distracting hoo-ha about Scrotus pardoning Flynn?

I think no jail time is a brilliant move- sets a precedent that being forthcoming, pleading guilty and being in complete cooperation with the feds is worth doing rather than protecting 45 and hoping for a pardon for ‘covering’ for him. It also completely renders him impotent with all this dangling of pardon carrots business.

I was refreshing here and Twitter as I tried to get to sleep last night and finally gave up fell sleep at 1am. Grin

Flynn his son too was such an obnoxious person on the campaign that I really would like them to lock him up and throw the key away. Obviously they are saving that for Manafort, who I can't get quite as bothered about.

So, it might be some consolation if Flynn is instrumental in bringing in Trump (and Jnr and Kushner) but I'm not quite sure what I think atm. Looking for some Maddow type dot joining.

Interesting stuff re Mueller and the sentencing recommendation... definitely a lot going on between the (redacted) lines there!

I have been following Russian and Ukrainian news my whole life and can personally comment that I have never seen Russian media report meetings, dates, locations, conversations while American media is completely kept in the dark. It’s really something watching this the past 3 yrs

Flynn doesn't come off as naive to me -- the most generous interpretation is that he was out of his mind during his crime spree. He is implicated in VERY serious crimes involving not just Russia but Turkey, and not just collusion but illicit nuclear energy deals. He's dangerous

And

I have no idea why you think Flynn won't again damage democracy. He just spoke at a meeting of wealthy right-wing extremists in my city, where he was feted for his betrayal. He is full of intel, has illicit ties around the world, lacks shame, seeks to profit. Very dangerous.

And

It's been less than four months since Flynn spoke and was honored at a national gathering of right-wing extremists hosted by Gateway Pundit I'm rather skeptical he will follow the Dean path. Much more likely he's a turbocharged Oliver North -- and possibly w/o POTUS removal.

And

Yeah people seem to forget that on top of everything, the guy is a nut. When Flynn wasn't out trying to buy mind-reading equipment from former KGB (true story), he was making illicit deals involving nuclear material. People feel safe with this freak on the loose?
