If this was a client of mine & he testified like this before a Grand Jury in his defense, I’d be very concerned about the prosecution bringing perjury charges in addition to the charged crime itself. The amount of provable lies & misleads are remarkable.
Beyond that, his testimony & behavior paired w/ Ford’s credibile testimony would all but ensure a grand jury vote for attempted rape. (Note: NY requires corroboration to indict, but think calendar would be sufficient, let alone anything prosecutors would find after investigation)
Note: The standard at grand jury stage is probable cause. Prosecution does not need to prove guilt beyond reasonable doubt. Grand jury is a protection afforded to defendants in NY (& other states & Feds) bc a felony charge is a big deal. But I believe there’s probable cause here.
Last note: Prosecutors in Brooklyn *rarely bring perjury charges for testimony in grand jury. But his testimony was so sloppy, behavior toward questioners so rude, & demeanor so unhinged, that these seemingly calculated mistruths about things big & small could push them to do it.
