I think my friend should pay, she thinks we should split it?

Driving a friend 4 hours away for an operation (cosmetic) and will use 2 full tanks of fuel in my car, cost of a hotel, food while I'm there and I'm using a days annual leave.
She wants to split all costs down the middle, whereas I think I'm using my holiday entitlement and 2 days of my time (which I am more than happy to give up) but don't think I should be paying for fuel, or for the hotel? I've said I'll pay for all my own food.
Her logic is we're both going so why should only she pay, she's already paying lots for surgery.
My logic is I wouldn't be going if it wasn't to do her a favour so don't see it fair to split costs.
Whats the right thing to do here? Don't want to be mean but trying to be fair...

I'd love to see her face when someone actually manages to get it into her thick skull that:

a) She's the debtor
b) The arrangements were for her to make. HER responsibility. Hence the above. Given the fact that she's offered you a chance to make it right, I don't believe for a second that she's cancelled, but just say if she did and lost the money then it's fuck all to do with you - this whole thing is HER fault.

If she was that worried about losing the £13k she had already borrowed splashed out paid out, then she should ....

a) have thought twice before pissing you of. Both initially when she expected you to pay for the privilege of helping her out (and being her nurse maid) and laterally when she made it clear that if she had to pay for you the "friendship" would be over but only once she had used you

and/or alternatively

b) considered employing a Carer to meet the hospital/cosmetic clinic's requirements - for example from https://www.mylifelivingassistance.co.uk/types-of-care/specialist-care/post-injury-and-post-operative-care/ and then hiring a taxi/uber/private hire to get home. That would, I would've thought, been better than "losing" £13k with nothing to show for it

She’ll blame OP when she is made bankrupt and sleeping under a bridge for refusing to make payments on the £13,000 as it is clearly up to op to make the payments as it is HER FAULT.

This is a legally enforceable agreement between 2 it more parties. Each party promised to do something for the other in exchange for a benefit.
So unless she can argue 4 hours in a car with her, 2 days twiddling your thumbs 4 hours back, carrying her cases etc the kids of 2 days leave and all the costs somehow benefits you - she’s got no hope of proving there was any kind of an enforceable legal contract in place.

Surely there’s an app for surgery chaperones ? She should post on taskmaster and ask if anyone is free for the time to chaperone her if she pays costs. More expensive than a friend but cheaper than 13k

Bert is right. Although you did initially agree to take titzilla when you then stated your terms she didn't agree. You then pulled out of the contract agreement before she counter offered.

What you need to make sure is that you haven't agreed to take her without any terms on your part. That yes you'll take her end of.

What people forget is that you don't need a formal signed bit of paper to enter into a "contract" however a gentleman's agreement is a lot harder to prove than a formal bit of paper.

A bit like when someone agrees to buy something from you on Facebook and then doesn't show up. They have actually broken the contract and could be sued. (Would just be pointless unless it was for a large sum of money)

However I don't think you need to worry as it sounds like she is just trying her luck.

If it were some kind of serious health-related surgery the NHS would be picking up the tab. I know things have got quite bad with the nhs but I think if it's the kind of 'touch & go' procedure she's implying then they would still do it.

I do love these people who throw threats about of 'hearing from their lawyers'. Like Mishcon de Reya are on red alert just waiting to act on her latest legal dilemma.
