Why would he ? Clearly a Texas grand jury found it perfectly acceptable to point a gun at someone without carrying out the procedures to ensure it was cleared.
And to be fair, it's an easy mistake to make. Which is why the first commandment of guns is do not point them at anyone. Ever. Unless you have already formed the intent to pull the trigger, and know that it could result in death.
(This is why it concerns me UK police get a free pass at times. But that's another matter).
