So sorry for the delay. I know I promised I'd do another thread after dinner last night.
Then sort of had second thoughts as some posters started commenting on my previous thread that I was enjoying the drama, then tattle started getting involved etc etc.

I have been blocked on social media, as well as family and friends. We've all been turfed out but who cares. I have my lovely shoes back.

Letter was sent signed for today.
Hopefully she receives it tomorrow!

A happy ending (and £300 odd short) but that's what I'm aiming to get back now.

I found this thread thanks to a poster responding to it on completely the wrong thread, but I'm glad I did!! Have read through it all and don't understand why so many doubted you OP. But then I also don't understand why anyone would ever bother to make up a story for a forum either!! Glad you have your shoes back and I really hope you also get your money soon!

I know you didn’t want people to comment on the letter you sent but I’m not sure if that’s legally watertight. You might need to send another one and ensure you cover the points here:

theres literally templates you can use online so I’m not sure why you sent yours, it doesn’t read as professional or unemotional…

Also criminal and civil litigation are handled separately. You don’t need to reference crime numbers or police involvement in a letter before action as this is for civil proceedings.

A letter before action is more for you to cover your back and show the court you tried to be reasonable ie offering alternative dispute resolution.

I can’t help but think you come across as unreasonable by mentioning irrelevant parties she owes money to, or by noting the police report. Courts consider the proportionality of the steps taken compared to the size and importance of the matter.

This CF is just unbelievable. I really hope you get your money back and good for you for taking it further

I am glad your Mom was spared being scammed. Good for her for noticing that something was off, but usually, until it blows up with the CFer, no one says much lest they be thought a bully.

The letter is me coving my own back, offering her a chance of resolution before intake further action.

I think it looks quite professional tbh..

The reason I added about the other people is because she has scammed a group of us. I wanted her to know that we all now know what she's like, as there was a chance she'd probably ask one of our friends to 'borrow' the money from them.

I had half the people telling me to put the crime ref and half saying don't. I wanted her to know I've reported it to the police as if I didn't she would probably call bullshit that I even reported her in the first place and probably ignore my letter.

To the poster who said OP should have written her letter before action as per LexLaw. LexLaw deal with high value litigation (£500k +). OP is a layperson and this is a low value small claim. Her letter is perfectly acceptable in the small claims court.

OP has conducted herself admirably - remaining polite even with outrageous insults.

Forget all the naysayers on here telling you you've done something wrong or the shoes look fake etc. I hope your stress levels have come down a bit since getting them back.
