Looking for advice on this benefit.
I applied for this just over 2 months ago, I sent 3 forms of proof of illness and had a video call appointment to confirm identity.
I called social security Scotland to check my process of claim and they say it’s awaiting a case manager.
Does anyone know how long I’ll be waiting for a decision?
Seems a very long, drawn out process.

I phoned them on the 26th and asked about my application, they told me there was no update yet, this was in the afternoon mind you..
Then I phoned earlier today and they say "the decision was sent out to you on the 26th" I have both phone calls recorded using an app , I always records phonecalls because they can lie about it

Does anyone of you know if you have to report the ADP award to the UC if you have a lwrca and if it has any impact on it?

Hi@Kajakaja no if anything it does state on the info from SSS they advise to apply for UC LWRCA, claiming ADP, doesn’t affect this benefit!

Kajakaja · 21/01/2024 14:15

@Piseag123 Thank You!

Piseag123 · 21/01/2024 17:36

@Kajakaja no worries 👍

Kajakaja · 24/01/2024 00:44

I previously received a standard rate for mobility - £107 per month. They awarded me another award and I get a total of £318 per month. How is it calculated?

Allyballybee445 · 24/01/2024 10:47

@Kajakaja I have enclosed the rates for you below I have no idea how your £318 a month is calculated you may need to wait for the letter
If you're awarded the daily living part you’ll get either:
£68.10 a week for a standard award
£101.75 a week for an enhanced award
If you're awarded the mobility part you’ll get either:
£26.90 a week for a standard award
£71.00 a week for an enhanced award

If your mobility needs have changed that will be why the award has been changed. If this award is as a result of a review the decision will be based on information you have given - possibly detailing any change in your condition. You have been moved from the standard mobility award to enhanced. This usually means that the decision maker is in agreement with the assessor, that you have a great deal of difficulty in moving around, if it’s for physical disability, or that a mixture of mental health and physical conditions have resulted in enough points to be awarded the enhanced rate. Either way, you will get a full explanation of the decision when your award letter arrives.

In England there are plans to link PIP - the equivalent of ADP - with UC. They will be scrapping the work capability assessment and UC claimants will only be eligible for the LCWRA addition if they are also in receipt of PIP. Not sure if it will be the same in Scotland.

Hi all

Does anyone know if appeals are also taking longer than their target timescale? I sent an appeal on 27th December and haven’t heard a thing back from them and it’s now 24th January 🙈 I mean it’s no surprise given that this has been ongoing since January 2023, but reading online it suggests that they have 7 days to send to the first tier tribunal team and inform me. I haven’t heard a thing and wondering if anyone knows what I should expect? Thanks

Kajakaja · 24/01/2024 11:51

I spoke on webchat, and i get this information so I need waiting for letters.I reported change only in daily care but i think they changed mobility as well after tranfer to adp.

@Wizwiz I sent my appeal November 18. Sss had until Jan 15th to respond. They responded Jan 18th and my portal was updated 25th inviting me to respond and to give them dates I can't attend a hearing in the next 8 weeks. I think when it goes to appeal the timescales are pretty bang on.
SSS responded and lowered my award saying they got it wrong at re-determination stage and they removed my communication points as it's evident in my appeal packet I don't struggle with communication. But I wrote that over 8 weeks and smoked a lot of cannabis to make me focus on it. Lol their award still gives me full daily but no mobility and just proves they don't know their arse from their elbow. If the award can differ so much between initial, re-determination and now a third time for the appeal response. So I just responded saying this is exactly why it has to go to appeal cos their destroying people's lives as they have no idea what they're doing. So just wait it out. I'm sure you'll hear soon. Good luck.

Rocksdad · 31/01/2024 11:17

@Wizwiz sorry Wiz, have they not responded and sent you a link to the portal or anything?! I'd chase that up.

Wizwiz · 31/01/2024 11:48

@Rocksdad thanks for replying and for your help. I’ve got am email with an attached letter from SSS advising that they have received my appeal letter, I got this last week. It also has an attached doc with 121 pages which is my file by the looks of things, from the start to end of the applying process. There isn’t anything that mentions a link or a portal? No idea what this, do they give me access to this? Did you have to go to a hearing face to face?

thanks

Rocksdad · 31/01/2024 11:51

@Wizwiz I called sss and asked if they had sent the paperwork to appeal people. She told me they had within 7 days. I asked for evidence. Turned out they hadn't. But I think that pushed them. So they finally sent it the following week and I got an email from the tribunal people saying they've accepted my appeal and they give you a link to register and you can see your file and any response from sss etc. The link is in the email from the appeal people at the Scottish courts

Rocksdad · 31/01/2024 11:56

@Wizwiz sorry I missed the end. My appeal hearing isn't set yet. They asked for any dates I couldn't attend between now and march 26. I got offered a phone call or paper hearing. I opted for paper hearing as I can't be arsed with them anymore and I've sent enough paperwork.

Wizwiz · 31/01/2024 11:57

@Rocksdad sorry I meant the email was from the Scottish courts people and the attached letter (added here). It just says above the bit ive screenshotted out that they have received my appeal and gave it a reference number. What should I expect next? Thanks 😊

Rocksdad · 31/01/2024 14:57

@Wizwiz i got sent a couple emails like above. I also got text messages saying they’ve accepted the appeal and to follow the instructions on the email to register for the portal. They then sent a portal link

other than that, sss will respond and you will be sent a copy. In mine they have explained why they’re reducing my award again and nothing else worth writing about.

Wizwiz · 31/01/2024 15:07

@Rocksdad thanks for your help. I’ll wait and see what comms come next.

Rocksdad · 31/01/2024 15:09

I got the portal link before everything else, well same day. I don't know enough about the process as maybe they don't give them out to everyone or something, I honestly don't know. The bottom of the emails I have from Rebecca and the team leader Brian all have the user portal link at the bottom.

I applied in June 2023. Last week on Monday I was told in a webchat that it the person will escalate my case. Had a phone call on Friday at lunch time. How long will it take from now til a decision / back payment is made?

DadOf2rascals · 05/02/2024 11:59

My application took about 12 weeks to be completed and decided , I have a life long chronic neurological disorder which is maybe why my case was looked at so quickly?

Piseag123 · 05/02/2024 13:03

Hi @mami2015 I applied in June too, my application including re-determination decision was completed on the 19th of December, backdated payment was made on the 29th of December, so overall it took about 5 mths, however, every case is different, fingers cross you hear soon, keep checking your bank account, best of luck 👍

mami2015 · 05/02/2024 13:26

This morning I asked for an update on the webchat. Got told a decision was made last week and a letter is send out. 🙄I hate waiting 😂
