Adult disability payment

Looking for advice on this benefit.
I applied for this just over 2 months ago, I sent 3 forms of proof of illness and had a video call appointment to confirm identity.
I called social security Scotland to check my process of claim and they say it’s awaiting a case manager.
Does anyone know how long I’ll be waiting for a decision?
Seems a very long, drawn out process.

I'm interested in this too. I get switched to ADP in April and my review starts in June and the fear has already kicked in. Can't sleep at night over it all. My main worry is losing my motability car. That is my lifeline. I haven't heard much anywhere about ADP reviews. I am hoping that no news is good news!

If you’re switching from DLA to ADP, that’s not a review, it’s completely new application and assessment based on how your condition affects a range of activities assessed. ADP isn’t assessed in the same way as DLA and because you qualified for that doesn’t mean you will be awarded ADP. Make sure you complete the application form as fully as you can and send copies of any medical evidence with your application form. Remember it’s not the fact that you have a particular condition that matters, it’s how it affects the activities assessed, which are designed to give an overall picture of how your daily life is affected.

@RumHam - it's a worry isn't it? I've tried to search online but haven't found much.

From what I've been able to find they might send a letter out asking if you have any changes. If you don't you tick a box to say everything is the same. If you have any changes at all then you would fill out the form and give details. They may request evidence.

I'm thinking that ticking a box to say no changes just sounds too simple!

Yeah from what I've heard all ADP reviews are 'light touch' but I'm taking that with a pinch of salt until I get my review forms through in June. I've heard that too that you can just tick no change but I might treat it like I did with my last PIP review and just send in evidence whether they ask for it or not. I sent in my medical records from that last review before that, letter from my CPN and my hubby done a carers report. I think I'll just do that again. Hope your review goes well!

I'll make a post when mine comes up and I have some updates so people know what to expect. All I know for certain so far is that the wait times are hellish!

If you have your original PIP application form it would be a good idea to have it with you when you complete any ADP paperwork, so you know what you’ve said previously.

One thing I'm worried about is whether I should have informed DWP that I was diagnosed with psoriatic arthritis since my last review. I didn't feel the need since I already had enhanced for both parts and already had the relevant points for moving around and some daily living parts for another condition that maybe the arthritis could then have given me. I'm just worried that'll go against me when I have my review and it'll be treated more like a brand new claim like reviews usually are when a new condition is mentioned.

@MimiAberdeen I received the same award as you in early December and like you felt I should have received more points for mobility I put in a redetermination in mid December I received a phone call asking for some more info last week and received the new award on Monday although the points for both have increased I was still only awarded standard Daily my payments were still being made during the redetermination process. I do not have the energy at present to go to appeal as I am dealing with the stress of moving from Tax credits to Universal credits.
The free bus pass for myself and a companion has been really useful and I would hate to lose this and the money if I decided to appeal.
Seems to be really hard to get the mobility without a mental health referral.

They won’t treat it like a new claim. Reviews are designed to pick up any changes in condition since the award was made - if your overall level of difficulty is the same, or worse, the new condition may attract a few extra points here and there, but the award will stay the same because you’re already on the enhanced rate of both parts.

Claimants are required to report any changes, whether they are likely to affect the award or not, but in my experience if a claimant is already on the maximum award, they don’t generally report changes for the worse until the review stage. You still need to report it on your review and they will still need any medical evidence you have to support it.

Thank you for your reply, that's a big relief. I absolutely dread any kind of benefit review. I especially dread this one since ADP is new. My biggest fear is that I've been discharged from CMHT as there's no other input they can offer me. I'm 31 and been under them and CAHMS since I was around 14 and I've had multiple therapies, CPNs etc but I was discharged last month after they said I've done everything they offer and even though I'm still struggling, there's nothing else from them. They told me to go to my GP and the CPNs that work at the surgery once a week, look into private charities for counselling and/or therapy or go private. I'm worried this going to look like I've improved when I haven't and I'm still at the GP every 2 weeks for my MH problems. My GP wanted to put a complaint in against the CMHT for how they've treated me (not just with that discharge but with other things too, it's been builidng up for a couple of years) but I don't have the energy plus dealing with CMHT made me worse tbh. They have such a stigma for the conditions they diagnosed me with. My need are still the same - still the same symptoms and struggles, still on meds, still at the GP often, still need my hubby to do things for me/help. The only difference is that the CMHT have discharged me. I've got proof that they discharged me 2 years ago to send me to the health psychologist but she wouldn't take me on because of self harm and dissociation and she referred me to the CMHT psychology dept who said I'd had significant input from them already through the years so they rejected me, I then went private and the psychologist said she recommended DBT but she couldn't offer it but wrote to my health board, GP and CMHT saying this would help me but again, it was rejected saying they don't offer it to more and then the CMHT accepted me a couple months ago and I was told it would be a brand new assessment but it wasnt an assessment at all. It was to tell me face to face that I'd done everything they offer and they couldn't help any more. I wasn't once asked about my symptoms or struggles, they just handed me my discharge sheet and that was it. I was in and out within 10 mins.

Sorry for the novel. Once I get started on this subject, I can't stop! Thanks again for your replies.

Live chat today told me a decision has by made and a letter has been sent on 24/02 and to give it 10 days to arrive. I hate waiting!!

I would say yes. This is your chance to have independent eyes on your case and possibly get a different decision. The tribunal service will keep you informed and guide you through the process.

I sent back my review form for ADP in October I've just spoke to someone on the chat and they said we have everything we need for your review it is making its way up the queue for a case manager. Could they still require more proof from me even though they have said they have everything they need? Also will they contact my GP if I haven't put them down on the form as I don't leave the house and haven't seen my GP for a long time. I did send in a prescription with all my medication on it and a letter from OT with my conditions. I've been a nervous wreck waiting to hear. thank you

If they’ve told you that they have everything they need and your paperwork is on it’s way to a case manager, it usually means they have enough evidence to make a decision. Case managers are not medically qualified so the form and supporting evidence would go to an assessor first, to provide guidance for the case manager. At that point any medical professionals you list on the form may be contacted if necessary, and if they needed to see or speak to you, you would have either had a phone call from the assessor or a letter to invite you in for an assessment. So l think you’re on the way to getting a decision.

Not sure what you mean about the GP. As far as I’m aware there is a question specifically asking for GP details so you should have provided them regardless of how long it’s been since you’ve seen them. They would not routinely contact anyone named on your form, unless they needed further information or clarification. Hope that helps,

Thank you for your help ❤. Ah see I couldn't remember writing my GPS details on the form lol but its on my prescription anyways. I just thought if they are gona contact my gp they don't know what I'm like now as I haven't seen them for a long time,so if the gp gave a report on me they wouldn't have the correct info needed. Hopefully they have everything they need and I won't have to have a face to face ❤

Hi can anyone tell me wot to expect received letter today telling me they will contact me by telephone within 7 days confirm identity am now filled with dread due failing pip assessment last year failed 0 points a recently applied for A.D.P a have not sent any sort supported evidence regarding my mental health issues is this a assesment just so a know wot to expect .my pip assesor was very rude during my pip telephone call asking did i use FB did i attend special needs school questions a did not expect to be asked that left me feeling confused before decision due to telephone assesment her overall attitude a knew a failed she as good as told my daughter who was speaking with the female 14 minutes from start to finish a believe am entitled to some sort disability payment due years verbal abuse that led to person going prison 2\3 occasios

I can’t believe how long and drawn out this process is and how they get away with it. I applied in January 2023, was refused so I then made a redetermination which was refused so I then went on to file my appeal, all very swiftly within my timescales and the appeal hearing isn’t scheduled until August, 18 months since initially applying! Anyone else had similar experiences? They advise I can send additional information on to support my hearing. Any suggestions on what I should send that will help
me? Anyone else been in this position? What should I expect from my hearing.

The system is overwhelmed in so many areas. Huge numbers of people applying for disability benefits and a lot being turned down so a lot go to appeal.
They say that your condition at the time you completed the form is all that is looked at but I have known people send additional information close to appeal date and they have taken that into consideration and made the claimant an offer, so who knows. The tribunal panel ( if the same as PIP ) will have a disability advocate, a Dr and a judge on the panel. their job is to determine if the law has been correctly applied in relation to your claim, so to check you have been awarded the correct points for each descriptor. they will ask questions based on your daily life, what you can and can't do etc.

Got my review back a couple of days ago. They upheld my award so still getting the full amount😊 was a long 6 month wait to hear back about my review was a nervous wreck but so had its finally over.

I have a query I was wondering if anyone could help with? My daughter was recieving CDP up until she turned 18 a few months ago, prior to that she received child DLA. I completed and returned the application for ADP in plenty of time prior to her turning 18, fully believing she would continue to receive CDP until a decision had been reached. I'm sure you can imagine my shock, and worry, at discovering that wasn't the case. I contacted them around a month after returning the form to check they had it, and the man said they had, everything looked fine, and when I questioned about continuing the payment he told me no, she wouldn't receive it. Apparently there's a rule if you turn 18 before December 31st last year you continued to get it.

Now, this is where the problem lies, the reason I believed she would continue to be paid was because it was CLEARLY STATED on Social Security Scotlands own website! I researched before returning the form, just to check the rules ect and read that page which said

"Child Disability Payment normally stops when the person reaches 18, so it’s important clients apply for Adult Disability Payment well before this time. If they don’t, their Child Disability Payment will stop.
If they apply for Adult Disability Payment before reaching age 18 and a decision has not been made before their birthday, then their Child Disability Payment can continue (until age 19)."

I raised this with them and they said they'd put it in as a complaint and someone would be in touch. They haven't. The website still states that info, there ZERO about having to turn 18 before a certain date on it.

Due to this my family as been left in quite severe financial difficulty, my daughter is autistic and doesn't understand she can't have, or do, what she usually would with the money she got. So we have had to make that up for her, it's £500 a month, and while we haven't been able to spend that amount we have had to scrip and scrape so her routine isn't changed with regards to what she used the money for.

I have put in a complaint as I said but is there any option to take this further? It's caused us months of stress, due to information they have published.

Any advice or opinions with regards to what I can do, or what they could/should do are welcome, thanks

hi i want to know how long does it take to get date for tribunal for adp? I got 7 numbers only fail from 1 numbers lol which I don’t understand why they did that but anyone have experience for tribunal in this case many thanks!
