Adult disability payment

Looking for advice on this benefit.
I applied for this just over 2 months ago, I sent 3 forms of proof of illness and had a video call appointment to confirm identity.
I called social security Scotland to check my process of claim and they say it’s awaiting a case manager.
Does anyone know how long I’ll be waiting for a decision?
Seems a very long, drawn out process.

@Invisimamma hi, I applied in January 2023, got refused then done redetermination that I got the refusal for st the end of November. I have since sent the appeal back and now waiting. That’s been over a year now since I initially applied.

So I asked for a copy of the assessors’ report In December and I have today received another copy of the summary included with the decision I phoned and was told that is the assessors report as it details why I was and was not awarded points. I don't have time to wait any longer as I only have 8 days left to ask for a redetermination,

The assessors report and the decision summary are two totally different things. The assessors report is completed at the time of the face to face assessment and is used by the decision maker (who is not medically trained and relies on the report) to make the relevant award. You absolutely are entitled to a copy of the assessors’ report so you can make sure it accurately reflects the face to face assessment, and if not, point out any errors as part of the redetermination application. If you are running out of time for the redetermination I would ring again and explain that you have the decision makers’ summary, but you want a copy of the assessors report on which the decision was based. I would then send in your redetermination application while you are awaiting the assessors report, and if there are any errors which you think may have contributed to a wrong decision, then you can send a summary of these in as additional evidence.

i have a review this coming June!
mom currently on universal credit not working but receive standard daily living on adult disability payment!

what are peoples views on the limited capacity for work? Does this affect my universal credit or Adp?

what is the process and also it asks when this change happened when do i put in from day one this happened or from when I received my Adp?

the problem with my condition is that I cannot work at all so that’s just not an opinion at all can’t shower alone let alone work!

please give some advice it would be much appreciated

@Lovelyjubbbly I am about to migrate from tax credits to universal credits in the coming days was meant to migrate in November but managed to get an extension due to my health

The Limited capacity for work on Universal Credits has no effect on either benefit although you can get extra money if you are placed in the LCWRA group.

The process is simple you hand in fit notes and after 12 weeks you are sent a UC50 form which you fill in and then you will get an assessment it much the same as ADP but some say a little more brutal must admit when I went through the process 8 years ago for ESA and had a face to face assessment I found it a lot less stressful and a lot faster than ADP.

You will be either found fit for work have limited capacity for work LCW or limited capacity for work related activities LCWRA as with ADP you can appeal.

As for when the changed happened I would put from when your health condition started or got so bad you were unable to work,
Hopefully someone with a bit more knowledge will be able to offer more incite as someone who is about to start the process myself its not something I am looking forward to.

There will still be an assessors report as it is the assessor (healthcare professional ) who decides whether or not a face to face assessment is necessary. If they decide not, they will still provide a report based on the paperwork you sent. Decision makers are not medically qualified to interpret your medical evidence, only an assessor can do this.

Hello @Invisimamma I had initially applied at the end of June 2023, determination was made on the 16th of October and I received my letter on the 20th of October 2023, I disagreed with the determination outcome as I didn’t believe that they had taken into account my two main disabilities! I contacted them on the same day, 20th of October to ask for a re-determination, which can take up to 56 days for them to make a decision as a ‘fresh pair of eyes’ looks over the original application along with any new supporting evidence! I received my outcome of the redetermination a couple days before Christmas, received backdated payment on the 29th of December I had achieved the adequate points for the daily living component! It is a longer process but hopefully they are now getting through the backlog and fingers crossed that you received word soon, just keep uploading any supporting information that you can gather! Good luck 🤞!

Can I ask what you included on the redetermination? My dp has just been declined ADP and I'm surprised tbh. He had a degenerative joint condition, my mum is getting it and her needs and condition are much less serious (imo). He did not include a lot of evidence and I don't know what else to suggest he includes.

Thing is his condition fluctuates and is worse if he's inactive, so he needs to spend a lot of time keeping active to prevent flare ups.

Just seen your post - could I ask how old your mum is because if she’s over pension age it will be attendance allowance she’s claiming, not ADP, and the eligibility conditions are totally different. That would probably explain why her claim has been allowed and your DP’s hasn’t. It doesn’t surprise me that a redetermination didn’t change the result - happens a lot and the next stage is appeal. For an appeal you can submit fresh medical evidence in the form of a GP report or copies of the GP record relevant to his condition. If he attends hospital you could ask the clinician for a report of his condition, or if there is a nurse specialist they may be able to provide something. You can also submit letters of support from family members if they are involved with his care - or indeed yourself. The main thing with an appeal is to be clear about which parts of the decision you disagree with and why. It will help if you can get a copy of the assessors’ report because that will tell you the basis on which the decision maker declined the claim.

If the decision making seems arbitrary it’s because it is ! It’s the same for PIP in the rest of the uk - basically down to the whims of the assessor, who may not even be sufficiently qualified to assess the condition. Your GP should be able to supply you with copies of consultant letters - they may charge, but it will be cheaper than the consultant supplying a report. Ring SS and ask for a copy of the assessors’ report - this is crucial to knowing why the claim was refused and you can use any inaccuracy to make your appeal. @Bettyboo691 Time frames differ for everyone 15 weeks is fast some wait a lot longer and when it goes to the decision maker they may ask for additional information hopefully it wont be much longer.

@Allyballybee445 I phoned today and ther saying ther wanting a discussion with ther in house practitioners they also said av sent in enough support information so I don't no exactly wat is being done last week sone one said they had a discussion last week and it was finished n they said its in final stages I don't no I did apply last year but got refused coz I didn't send any information in this time isent in lots and lots do u have any idea how long they could not tell me that they said it could b ling why do we get told different things when we phone thanks in advance xx

@Bettyboo691 The same happened with me, every time I phoned it was a different update. They were meant to speak with in house practitioner one day and I was told to expect outcome letter by the end of that week then nothing came so I called again to be told the discussion hadn’t happened yet. Eventually got an outcome letter about 3-4 weeks after all that messing around, I was refused. I applied in January 2023 and my claim is still ongoing, was refused then went through redetermination which took longer than their 56 day deadline and was refused also. I sent my appeal a few weeks ago now and I am still waiting on any acknowledgment of it.

Hello.
I reported the change of circumstances a year ago in January to the PiP, they received the documents in May because the transfer took so long. For over a month I have been receiving information in the chat that the decision has been made and forwarded to the decision maker's manager for approval.
Today i spoke again and one lady said that my aplication is still in the queue waiting to picked up my case manager.
Have any of you had such a problem? I don't know what I should do because many people who applied after me have already received letters.

Hi @Kajakaja I applied in June last year, I disagreed with the decision so I requested a re-determination which was logged on 20th October, new CM looked over my application, my award was made on the 19th December, backdated payment was received on the 29th December and 1st official ADP I received this week, you may hear within the next week, have a read over this thread, as sometimes money is your account before you receive your letter, if nothing has changed mid week, next week, contact them again, keeping fingers crossed for you 🤞

I wrote again because I was surprised that 3 people in a month said that the decision had been made and today one person said that I was misled and the application is still in the queue.
After another conversation, I received information that she can see a pending backdated payment on my account and a new benefit amount for January 24. So I'm waiting. Thank you for your answer🤞

@Bettyboo691 @Kajakaja I think the problem making people believe they are being miss informed is that the application can get bounced about from case manager to in house practitioners to decision makers and back to start the process again if the decision maker asks for more information . In my case I ended up with 3 different case managers one used in house practitioners for more info then passed it to a decision maker who decided they wanted more info from my GP it was then passed back to a case manager who then requested the info which the GP failed to provide so then it went back to a decision maker who decided more information was needed from me back to a case manager who then phoned me to request the required information and then back to the decision maker, When I asked for information on the application like others I was being told it was with a decision maker and then when I phoned a few weeks later I was told conflicting information, The staff on the phone and web chat can only tell you what the system says but due to how long my application was taking on the last occasion the web chat advisor actually spoke to the case manager and gave me more details about the process.
I presumed that the case manager and decision maker were the same person its all so confusing and the waiting time is ridiculous.
From start to finish it was over 10 months for a decision to be made on my application and I know a few people who have been waiting over a year 😯hopefully you will both receive your decisions soon as the waiting for me was soul destroying.
