Adult disability payment

Looking for advice on this benefit.
I applied for this just over 2 months ago, I sent 3 forms of proof of illness and had a video call appointment to confirm identity.
I called social security Scotland to check my process of claim and they say it’s awaiting a case manager.
Does anyone know how long I’ll be waiting for a decision?
Seems a very long, drawn out process.

Hi all

I’m still here on this thread. My original app went in on Jan 2023 (my initial app). I got awarded 6 points, done my redetermination and got all my points took away during the redetermination and my appeal. I have only just had my tribunal hearing today. How long until I should hear back? Has anyone had any success from their tribunal hearing or similar circumstances to myself? Has anyone had to appeal again after their tribunal? Is this an option or does it go back to a new full application if I wish to proceed further? Thanks for everyone’s help already 😊

I have a query I was wondering if anyone could help with? My daughter was recieving CDP up until she turned 18 a few months ago, prior to that she received child DLA. I completed and returned the application for ADP in plenty of time prior to her turning 18, fully believing she would continue to receive CDP until a decision had been reached. I'm sure you can imagine my shock, and worry, at discovering that wasn't the case. I contacted them around a month after returning the form to check they had it, and the man said they had, everything looked fine, and when I questioned about continuing the payment he told me no, she wouldn't receive it. Apparently there's a rule if you turn 18 before December 31st last year you continued to get it.

Now, this is where the problem lies, the reason I believed she would continue to be paid was because it was CLEARLY STATED on Social Security Scotlands own website! I researched before returning the form, just to check the rules ect and read that page which said

"Child Disability Payment normally stops when the person reaches 18, so it’s important clients apply for Adult Disability Payment well before this time. If they don’t, their Child Disability Payment will stop.
If they apply for Adult Disability Payment before reaching age 18 and a decision has not been made before their birthday, then their Child Disability Payment can continue (until age 19)."

I raised this with them and they said they'd put it in as a complaint and someone would be in touch. They haven't. The website still states that info, there ZERO about having to turn 18 before a certain date on it.

Due to this my family as been left in quite severe financial difficulty, my daughter is autistic and doesn't understand she can't have, or do, what she usually would with the money she got. So we have had to make that up for her, it's £500 a month, and while we haven't been able to spend that amount we have had to scrip and scrape so her routine isn't changed with regards to what she used the money for.

I have put in a complaint as I said but is there any option to take this further? It's caused us months of stress, due to information they have published.

Any advice or opinions with regards to what I can do, or what they could/should do are welcome, thanks

I was a disability outreach worker and had the same problem with PIP for one of my clients. The problem turned out to be the date by which the completed form has to be received - clearly shown on the application form, accompanied by a warning that applications received after this date would result in the current award being closed. I’m retired now so not sure if it’s still the case, or is the case with ADP but maybe start there. If there is no cut off date and the form simply has to be returned to be received before the child turns 18, then I would follow up to make sure a complaint has been lodged, and I would definitely advise my local MP - they can ask an MP’s question which the department can’t sidestep, so it’s a good way to get an update if not a quicker resolution.

As far as I know if you are turned down at tribunal you can’t appeal again unless to an upper tribunal, and that has to be on a point of law. If you’re turned down you would have to reapply with fresh medical evidence - no point in submitting the same evidence as it would only result in another rejection.

In my experience as an outreach worker, tribunal decisions were usually given on the day - unless you didn’t need, or didn’t choose to attend for some reason, in which case I think the decision has to reach you within 28 days. I’ve been retired for a while so that may have changed.

Did they give you an explanation as to why your points were taken away ?

@Rosscameasdoody thanks for your reply. No they didn’t really give an explanation. The SSS rep today gave 4 points back to me at the end of my hearing. I understand this doesn’t mean that I haven’t made the criteria and that the rest of the independent panel go away and make a decision based on my oral evidence today over the telephone. I think they said I would hear back in the next day or two with my decision.

Hi

it’s been a week since my adult disability first tier tribunal and I still don’t know the outcome. Has anyone else been in this position? I haven’t received any emails or letters from them and they didn’t tell me the result at my tribunal last week. I’ve been looking online and it seems most received their outcome in a few days or received a phone call from them. Can anyone enlighten me of the process / their experiences at this stage? Many thanks 🤩
