Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #65

TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

Here we go. Every tribunal thread needs a recipe discussion.

250g porridge oats (the cheap type, not large ones),
150g Butter,
2 generous tablespoons (75g) Golden Syrup
half a tin condensed milk
baking tin, no bigger than about 18cm x 28cm
Method:
Preheat the oven to 160 degrees c
Line the baking tin with baking parchment.
Melt the butter in a large saucepan over a medium heat and add the syrup. Keep gently heating and stirring until all is melted and mixed.
Add the condensed milk and mix. Bring to the boil for about a minute. If I'm honest, I just bung the milk in at step 3.
Remove from the heat and gradually add the oats, folding them in. All the oats should be coated, and the mixture quite dense, but still sticky. Don't add so many oats that the mixture becomes dry.
Pour the mixture into the tins and spread about so that it lines the tin to a depth of 2-3cm. Don't squash the mixture in, just spread it evenly.
Bake in the oven for about 15mins. You should take them out when they just start to go brown round the edges, don't leave longer than this. If they're still squidgy in the middle that's fine, they set on cooling.

That, friends, is the mistake that flapjack rookies make. They bake them until they look cooked, which is far too long.

Yes, I also remember a witness in another case doing it but can't remember who.
In the case of Tait I wonder if there is also an element of trying to project a relaxed, 'I'm so approachable' persona. This would bolster her suggestion that Sandie was unreasonable in not just picking up the phone to have a good old chat with her about it all.

There was one witness - I think in the Jo Phoenix case - who tried this overfamiliarity with the judge. It did not go well.

Two thought on NW's write up of yesterday:

"Fraser accepted that if the posts [the Fred tweets] were brought to the RCN’s attention there would likely be an investigation."

They have certainly been brought to its attention now. I wonder what will happen.

SP's demand that Fife:

"accepts that its staff have the right to discuss matters of common concern and organise to address them"

A union should be right behind that, shouldn't it? That's their entire founding purpose.

I believe you just have to need OR want one. It's a bit like the cat distribution network.

Camels are more skilled at providing emotional and moral support, gerbils at seeing to material needs.

For an even better experience in severe emergencies, the red panda / quokka combo is suberb. More readily available down under.

@fanOfBen I recommend witch hazel (soak a cotton wool pad and use as a compress) and arnica cream for helping the bruises subside.

@Lougle I hope you and your DD are doing OK, and have managed to find something otherthan bad flapjacks for sustenance.

Ah, this was what I was unsure of -- their different skillsets and which were required for different kinds of distress. Re: boiledbeetle's reply, I don't doubt that anyone who requests either kind of support creature (even implicitly) is entitled to receive one.

I am just going to jump in to wish everybody well; especially those who are under the weather (or family members) and those in employment disputes.

Condensed milk in flapjacks, eh? I might have to rethink my recipe (sounds VERY sweet, so I might stuff some dried cherries or something in).

If the Judge is as ignorant as the two RCN reps claim to be, NC is in trouble, I think.
