TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

The ideal world being put forward by these RCN bods is that when members hit a problem at work they have to put all of their trust in the RCN to tackle it while the RCN will identify those cases that don't forward the interests of the RCN and will slowly smother them.

Highly recommend Pexip!

Thank you.

I've just searched for Pexip and will investigate further later. Is it very expensive?

GT WOuldn't send something c SP case to all members
NC Yes, you said that to DH> Where does SP ask you to mention her
GT A phone conversation would have been helpful. This would be done at a higher level in partnership.
NC You couldn't write this for SP because of higher level

GT I would have had to mention SP
NC Your understanding of SP letter is wrong. SP letter is about it affecting all f members. Not about her. About general workplace rights. You took it upon yourself to convert general please confirm you understand rights to a personal just about SP

In my experience there is only one reason someone presses for phone calls when one has been very clear you want written comms only; they want to say something that they don't want to put in writing.

Or they want to later accuse you of saying something bad during the call.

There are three reasons but connected:

  • to say something they can't put in writing
  • to bully you out of a position you have taken
  • to lie and say that you changed your position in the phone call.

Or they want to later accuse you of saying something bad during the call.

Or misrepresent what you said on the phone (I’m looking you, Stuart).

NC No reasonable employer could have objected to what SP was asking for.
GT I did ask in my email.
NC You toned it down
GT Put it in my own words
NC re PCs. Employers and TUs don't agree that GC beliefs are reasonable. Message that discriminating against GC beliefs

is as bad as discriminating against other PCs has been slow to land
GT we know all PCs are protected
NC But you hardly knew about Forstater.
NC Fife sss - no man allowed to use. No reasonable employer could object.
GT No. SC judgment.
NC No reasonable union could object

I know I’ve made some very poor decisions recently, but I can give you my complete assurance that my work will be back to normal.
I’ve still got the greatest enthusiasm and confidence in the mission.
A phone conversation would have been helpful.

It is no wonder SP didn't speak to GT on the phone, she cannot understand simple written text without getting it wrong, god alone knows what she would have taken from a phone call and that is supposing GT could get past saying the word "hello" without fence sitting in some way.

She is embarrassing.

GT I wrote it in my own words
NC You turned it down
GT Wrote in my own words. Contact would have been useful. Would have been happy to rewrite but SP didn't come back to me.
NC You said not for you to write general letter to employer re employer abiding by law.

To be fair to Gillian, when I was in the CS there were lots of occasions where I opted to call someone instead of responding by email. Usually when it wasn’t entirely clear what the originator was talking about. In those cases I tried to follow up in writing by confirming my understanding of our conversation….. but Sandie’s request was brutally clear and concise. Either Gillian didn’t want to do what Sandie had requested or due to her own bias she couldn’t actually see clearly what Sandie was asking.

CriticalCondition · 29/09/2026 15:49

It's another reason for a phone call. To be able to deny you were told something.

Yes, I should have said one of the main reasons...😉

“Nobody expects the Spanish Inquisition! Our chief weapon is surprise... surprise and fear... fear and surprise... Our two weapons are fear and surprise... and ruthless efficiency.... Our three weapons are fear, and surprise, and ruthless efficiency... and an almost fanatical devotion to the Pope... Our four... no... Amongst our weapons... Amongst our weaponry... are such elements as fear, surprise... I'll come in again.”

Is it hello, hullo, or hallo?

Away to fuck with ye, Gillian! Stick yer partnership where the sun doesn’t shine

Scout2016 · 29/09/2026 15:51

She keeps saying she can't speak for the members. Is it not part of a rep's job to do exactly that?

RoseInAPot · 29/09/2026 15:52

NC You didn't tell SP you could do that.
GT No, an error on my part. I asked GT I checked - no others coming forward from membership.
NC If members fearful will be regarded as bigots if tell union rep unhappy c m using f cr, they'd be unhappy.

GT Disagree. In my experience members do come forward
NC Wouldn't come forward to union rep cos concerned cos a black man on ward GT Yes they would.
NC No context they could say I;m unhappy with working with black colleagues. Or sharing a cr with black collegue

GT Don't agree. Members do come forward with all kinds of concerns.
NC DU had left by now. So no one raising concerns re him now.
GT Didn't know DU had left.
NC No w can trust w sign on door ever, cos a new TIM could join the hospital today. Can't be sure until hospital

has confirmed to all their staff that ppl won't be allowed to use sss of opposite sex
GT I'd expect all staff to comply with law
NC But staff can't be sure.
GT Not fully aware of what disseminated down to managers re giving individuals advice

She needs reminding that the members are the purpose of her work not an interruption of it.

ickky · 29/09/2026 15:52

Yeah, I'll bet Sandie would be reassured.

Boiledbeetle · 29/09/2026 15:53

NC done

Scout2016 · 29/09/2026 15:53

If her presentation today is anything to
go by, an you imagine how insufferable a phone call with this woman would have been? Sandie was right to swerve it and stick to having things in writing.
