TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

One of the witnesses today was attacked by a paedophile prisoner from a high security unit who was fortunately prevented by prison staff from physically harming her. He then called her deeply unpleasant racist names. This is, according to one prolific poster, apparently worse than actually telling a urology consultant he was a man when seeking information about appropriate treatment of his urology problem. She'd called him by the feminine name he wanted but that is never enough for these entitled men.

Sandie sent a what's app group used to the black humour of those working in health care some bad jokes. Not my sort of humour but nothing to do with her right to undress without a man watching her. It's a very bigoted position - of the type that led to racist behaviour - to think some people have no rights because you think they are inferior.

I suppose this is an example of the standards of "accuracy" and "nuance"?

In the original hearing NHS Fife's barrister, Jane Russell, spent some time trying to portray Sandie as racist, homophobic, etc. She did eventually come up with some evidence when another nurse revealed that Sandie had once copied a series of jokes to a shared WhatsApp group, many of which were racist. Sandie admitted that the jokes were offensive, said she regrets sharing them and said she wouldn't do it again. She was also accused of making a racist remark to a colleague, but the colleague in question appears to have denied this. NHS Fife appeared to be attempting to argue that Sandie did not deserve Equality Act protection, but that is not how the law works. Her GC views are protected regardless of whether we approve of her views on other subjects.

Basically they were just trying to portray her as a right wing, Trump supporting, racist bigot. They were trying to undermine her credibility. And as we saw in the testimony from the nurse today from the Darlington case, who was also called a transphobic bigot, ( who also mentioned the
' be kind ' culture ), this gets used against any woman trying to assert their lawful rights against this insideous ideology.

I have to say, listening to SF 's testimony today, I still don't really understand exactly WHY Sandie was suspended?

AND, listening to the testimonies of the two nurses today, I just feel SO bloody angry about what these hard working, decent, caring nurses have been put through. When they have done ABSOLUTELY NOTHING wrong...!

I've been following this for years now and I've thought, oh it's all over now, we've had the Supreme Court judgement, but watching this today has brought it all back, the frustration, the anger, the madness of it. And hearing how a huge union, that mainly represents women, have prioritised the Grainger case over a massive, hugely important and influential case like Forstater, and how this utter numpty was so vague about it and just didn't seem to get it, or care, was enraging...!

Though her motivation for doing so is unclear. I have wondered if it was "look at this, aren't some people incredibly unpleasant writing this sort of stuff!" Or it could be that she has a medical profession taste for black humour, often said to be a survival mechanism because of the shit (metaphorical and real) they have to deal with.

I have lost count of the number of trans activists who have posted precisely the same set of 'jokes' in far more public spaces, in order to point their fingers at her. Hypocrites.

They are deeply unpleasant jokes but I think a lot of people don’t realise how extremely common it is after disasters etc for these sort of jokes to be spread. I certainly wouldn’t spread anything to a group of people I thought would be shocked or horrified by tasteless jokes (not talking about these specific ones because I wouldn’t send them, but I might send something else tasteless or crass so that’s my reference point). So the point is that was the culture of the WhatsApp group in general, and it was in private. I think we’d all be horrified if we got to see the WhatsApps of everyone we come into contact with.

I don't really think sharing that kind of content should be minimised, it was pretty disgusting, flagrantly prejudiced and racist.

However it was just one forwarded text and she apologised and I don't think it was much relevant to the case. It certainly doesn't follow from that that she can't be a victim of discrimination.

Many of us are simply tired women saying no to the phenomena of men now telling us they are also women.

They are not. It is offensive. Please stop supporting them. As a decent human I agree let them get on being a man in woman face but do not collude they can breastfeed - incredibly offensive. They are men.

I quite agree, which is why I am so very unimpressed (an understatement) with all the people who happily point the finger at SP while posting precisely the same 'jokes' on TwiX and other social media platforms, which are accessible to the whole world. They are saying very publicly "here are some horrible racist jokes for you to self-righteously enjoy tut tut about, and look at the terrible racist SP who shared them [in a small private WhatsApp group]".

Trying to ignore the man pretending to be a woman with a busy trad housewife lifestyle.

Anyway i took a look at all the time lines of the nurses facing disciplinary action.

It seems very apparent that the RCN were deliberately employing a lead boot approach so that these cases would be timed out for an application to an employment tribunal.

Especially obvious in Melle evidence.

One has to remember that in disciplinary cases that could amount to gross misconduct, l as a matter of legal requirement the Nurse must be told that the hearing could lead to their dismissal, loss of pension rights, and professional de registration.

So the level and panic in face of this can not be over emphasised.

And the liaise fair approach of the RCN is fucking well outrageous.

When catheterisation is required by a HCP they will need to discuss this with a doctor. Time will be tight. JM clearly explained a man needed catheterisation. How a man is catheterised is different to a woman. Had she catheterised the man in his preferred form as a woman she would have failed to first do know harm. JM assessed the situation and behaved professionally. Wasting time explains this man felt like he was female would have been ridiculous.

Had JM catheterised the patient as a woman his health may have been compromised. Let’s not forget the patient was racially abusive to JM whilst she was providing care. Police or prison officials had to physically restrain the prisoner from attacking JM.
