Tempest v Rural Payments Agency Tribunal Thread 3

Previous thread: https://www.mumsnet.com/talk/womens_rights/5548369-tempest-v-rural-payments-agency-tribunal-thread-2

TT substack: https://tribunaltweets.substack.com/p/tempest-vs-defra-and-rural-payments

Tempest (a TW) is claiming discrimination, harassment and/or victimisation on grounds of gender reassignment. Central to the claim is the existence of the Sex Equality and Equity Network in the Civil Service (SEEN). SEEN has been granted right to intervene. Parts of the original claim against the co-chair of SEEN (Elspeth Duemmer-Wrigley) and another party (Andreas Mueller) were struck out or narrowed. Another claimant, PQ, is no longer part of the case.

I will also note that Elspeth still has a garden in need of seeds and water to support the ability of SEEN to be an intervenor in this case. The claim originated because she said "only women menstruate" and a search with her name and those terms at the usual gardening website should point you to her plot.

ST: Disagree, my line manager can and should follow up such decisions, so it's fine to give opinion.

J: I think section makes more sense if begin p2096. I think Q is, your line manager is saying doesn't agree posts shd have been removed?
ST: Yes

NC: p2061 - transcipt of video by Perm Sec for Trans Awareness Week Nov 2022. Have you ever seen a PermSec promoting a 'biological sex awareness week' - even a half hour?
ST: No

NC: Or anyone else in DEFRA?
ST: [pause]
NC: It's not a difficult Q - why the theatrical pause?
ST: Not theatrical - just thinking

NC: You would know and would have told us if anyone senior had promoted 'biological sex awareness week'?
ST: Haven't seen anything

I have no words.

Re Bayeux Tapestry ticket queue- my bloke had the laptop on during one of England's group games, and got some fairly easily. So might be worth a punt later today.

From TT:

ST: I didn't think (1st tier) Forstater entitled me to bully anyone, or anything like that.

NC: In your WS - you talk at 6 effectively about the good old days b4 Forstater, and that there was a change afterwards. You say EAT Forstater was a disaster?
ST: Yes, changed everythign.

NC: In this claim - I think doomed attempt - is put Forstater back in its box, narrow its reach, and say it should apply
ST: No, saying workplace should be a safe place, I am sorry you cannot see that.

My comment: hmph!

BeMoreBear · Yesterday 15:11

NC: Nobody senior expressing support for SEEN and its aims?
ST: Haven't seen, no, but there are plenty of example of senior ppl supporting SEEN even if not saying so.

Examples such as...? Any that are not in your own head?

MarieDeGournay · Yesterday 15:11

NC: You thought GI was unchallengeable at DEFRA?
ST: No, that respect for colleagues was.

Just one of so many examples of ST being asked a q and rephrasing what it says to suit him. He does it all the time. I don't know how a cross-examiner is supposed to deal with that - apparently just ignore, and trust that the judge and panel are noting the deviousness.

GailBlancheViola · Yesterday 15:11

ST keeps going on about the Law and what it allows but fails to recognise that what he believed, or would like the law to be, was NEVER the law and it should not have taken the Supreme Court to point that out.

She's rattling him, by undermining his 'performance'

My guess would be that ST has been a poster here on FWR before. That phrase at the end is all too familiar!

He really doesn't like Forstater nor, no doubt, the FWS Supreme Court ruling.

It just shows how utterly dominant and dominating GI and it's cheerleaders was, dissent was not allowed.

From TT:

NC: Reality is that there has been relentless gender-ideology proselytising in DEFRA for years, isn't it?
ST: No

NC: I need to check a reference - excuse me a minute

NC: pp20-41 (int)
NC: Natural England pride network sharepoint page. It's 21 pages of GI propaganda isn't it?
ST: Haven't seen this
NC: Could you look now -
J: C's opinion won't get us anywhere

J: C's opinion won't get us anywhere

On this fact we can agree Judge. Tinkerbell’s opinions are pure nonsense. Even trans Reddit is quiet in relation to him.

MarieDeGournay · Yesterday 15:16

ST: No, saying workplace should be a safe place, I am sorry you cannot see that.

I am sorry you cannot see that - to a x-examining barrister in a tribunal??
he has no boundaries, has he? He thinks he can treat every woman with the same lack of regard.

'Goady' - that's the word I'm looking for. Saying something like 'I'm sorry you can't see that' in an inter-personal argument would be very goady and provocative.
In a x-exam it's just totally inappropriate.

TheywontletmehavethenameIwant · Yesterday 15:17

I'm hopeful, the judge has twice made a comment to him about wanting SEEN shut down because it's GC. It's not hard to see that Tinkerbell is the harasser not the harassed and I'm confident the judge has already spotted that.
Of course I could be wrong. 😂

I am working from home today and following this whilst doing a really tedious work task I have just let out such a loud howl of frustration at the utter crap this entitled knob head is coming out with, that the cat has run into the wardrobe to hide and my neighbour has knocked on the door to check I am OK!

Since we are on a break - side comment. Camilla was pictured with JKR yesterday at Holyrood House. (edit because I saw it today but the meeting was yesterday).

Trans reddit (and there is no bit of reddit that isnt trans) will be having the tantrum to end all tanrtrums.

Some heartening comments on the r/UK thread about that though!

Along with the usual claptrap, but, still, some sanity is lovely to see on Reddit where trans stuff is concerned

I'm exhausted after just a few days of reading ST's "evidence". How NC does this case after case is beyond me. I wish I had her fortitude.
