Judgment was handed down on 8 December 2025:
https://assets.publishing.service.gov.uk/media/6936ce28a6fc97b81e57436a/S_Peggie_v_Fife_Health_Board__Dr_Upton.pdf

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal.

The hearing was live tweeted by x.com/tribunaltweets and there's additional information here: tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-005 and tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-bd6.

There is already a wing in Edinburgh for trans prisoners.

Oh, but that's outing dontcha know. Tsk.

The chilling bit of the argument is that the Scottish Government "have claimed that trans inmates could kill themselves if forced to serve sentences in jails for people of their biological sex."

Whereas presumably it doesn't matter that a violent TIM in the female estate could kill one of the women prisoners or maybe even a female prison guard......

Yes, and does it never occur to them that a woman banged up with a potentially or actually violent man might feel a little bit suicidal too?

Anyone who thinks this kind of thing is ok is either thick or sick.

ArabellaSaurus · 29/01/2026 08:50

More on this tragic story. The SPS should have a good hard look at itself.

oh god that's so sad. that poor young woman and her wee brother too. I think it was very impactful to hear in his own words about his terrible loss.

Professor Louis Appleby has repeatedly highlighted that preventing suicide is made harder by simplifying the cause to a single factor. It is irresponsible to say that trans people will die by suicide if they are required to use the prison estate that aligns with their sex.

It beggars belief that the SNP are seeking to remove the safeguards that are delivered to females through single sex provision rather than simply creating additional safeguards for males with trans identities.

They honestly think that indirectly disclosing a male’s natal sex is a breach of human rights in all contexts.

There's another thread just now about a teenage girl being emotionally abused by her ex who threatens suicide to manipulate her. Classic abusive tactic.

People who threaten suicide as a weapon - if you do/don't do this thing FOR ME, I will kill myself - never actually do it.

It's emotional blackmail and is abuse.

I speak from experience.

ArabellaSaurus · 29/01/2026 11:01

Currently reading the fatal accident inquiry wrt Katie Allan and William Brown. Utterly tragic.

Judge notes Scotland has one of the highest suicide rates of prisoners in Europe. Also that it was 5 years before notice of Inquiry was lodged, and that several more have died since at Polmont. We are failing these young people, on so many fronts.

I noticed 'rip resistant sheets' are recommended for safety, but no mention of men being incarcerated with women.

moto748e · 29/01/2026 11:03

What an awfully sad story.

ArabellaSaurus · 29/01/2026 11:16

It is. And ten more suicides at Polmont since.

lcakethereforeIam · 29/01/2026 11:20

Is Polmont mixed sex?

That story is utterly heartbreaking. That poor girl slowly tortured to death.

ArabellaSaurus · 29/01/2026 12:07

Sort of. It's both a prison and a YOI, housing both, but recent changes mean U18s are not sent to YOI, afaik.

'Polmont is a national facility that houses a diverse population.

It is the only prison in Scotland to house young males aged between 18 - 21 years of age. It houses young people of all sentence types, including remand and those serving short term sentences (serving less than 4 years), long term sentences (serving 4 years or more) and life sentences. The majority of these prisoners come directly from court.

The female population are adults (aged 21 and above) who are transferred from other establishments. Women within Polmont can be remanded or convicted with either short or long term sentences.'

ArabellaSaurus · 29/01/2026 12:08

I'm not 100% clear on the layout. I think it was getting renovated recently.

Luckily, there's no chance women will kill themselves if forced to share with transgender men. Oh, hang on a minute... are you saying the dear little males are more important yet again? It looks as if a vote for the SNP is a vote against women's rights and for misogyny. I wonder if Nigel Farage will pick up on it? Somehow, I never expected to wish him luck.

100%.
It's emotional blackmail.

A relative used this threat on a regular basis to blackmail family members - it's a very common tactic.

She tried it on with me once about 30 years ago and I told her where to go.
She never tried it on with me ever again and she's still going strong.

Nah, he doesn't give a toss, still hasn't even the foggiest what the issues are. Remember a few weeks back when he fronted up his spokeswoman on gender stuff & she started bleating about "case by case" decisions, with his backing?

The poor daft woman was kicked into touch when Farage saw it wasn't playing well but he himself hasn't got further than a few comments to the effect that men in women's swimming is not quite the ticket, other than that he has naff-all to say beyond vague burblings about wanting to "respect and give dignity to everyone,"

(OTH, everyone knows that he wants to scrap the Equality Act, which has been so useful to women in fighting back against the BS of Gender Identitarians.)

The Times have interviewed Sandie

moto748e · 13/02/2026 22:56

That's a very good summation.

Great interview by Janice Turner with Sandie Peggie and a great overview of what happened.

moto748e · 13/02/2026 23:28

No worries, it's a very good piece, which tells the whole story very well. I remember when the Guardian used to do proper journalism like that; sadly, no more.

Seymour5 · 14/02/2026 06:49

Great article, thank you @moto748e
