NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

That song was the first thing I ever heard sung by Chris de Burgh, at a campfire in County Wexford in the late sixties – the first year his grandfather's castle was open as a hotel. I think someone who knew them told my mum they needed customers, and we were among the first to go there.

(It wasn't a family castle: his grandfather had bought it in a mad moment earlier that decade. My mother taught the General how to build a dry stone wall to keep the gravel from the drive off the grass!)

I used to love going to see Chris de Burgh live. #happy times But wow what a story about the castle!

I'm sorry; that sounded totally sidey, and it wasn't meant to be. That was the most amateur hotel in the entire world, I think. For instance, if you wanted a drink you went into the study where the bar was, helped yourself and wrote what you'd taken in a book that lived on the bar. And the castle was in a state of almost-repair; nobody was allowed up the tower until it had been made safe. And the cellar was full of dark oak panelling stacked against the walls waiting to be fixed somewhere upstairs, and was the only place there was room for the billiard table, on which Chris's brother Richard taught me how to play billiards. And when it looked like rain and the harvest not yet in, an "all hands!" was called and everyone, guests, hosts and all, rushed out to the fields to help a local farmer.

I had to actually listen to the song so not sure each line has the requesite number of sylables. I kept the chorus in same wording and added another verse. It is in my lunch hour so I had the time.

One change. Upton has 2 syllables to Puff's 1, which throws the whole thing out. 'Upton, who's a laydee,' instead of 'Upton, the magic laydee' gets it back into line.

It has not been a picnic. When I was first admitted they were so concerned I realised that I could lose my leg or life to sepsis. I went a bit delirious just before the first operation to debride the wound because I had been taken off antibiotics and the infection had taken control.

There is metal in my ankle and they had to stop the antibiotics because it couldn't clean the infection on the metal and I would get reinfected. The operation was delayed but once I had it they put me on very strong IV antibiotics and then after a week of growing cultures, changed the regime.

I then needed another operation that was cancelled four times before they prioritised me and managed to close the wound. It then took two days to discharge me and I was prescribed 12 weeks of antibiotics by mouth. 18 days in hospital in total.

I am very fortunate to be at home and it's easy to think that because I am home, I must be fine. I am fine but I'm also still unwell and gradually improving and it will be mid January when I'm back to my old self.

Thank you all for your lovely support and kind comments, not just here but on other threads as well. I really do feel very cherished by this community of unknown women. ❤️

I agree with the majority of what you say - but I have been saying why do we not have a single TRA bringing a claim for being denied rights? Surely Dr Upton is the very model of the boy who cried wolf in this respect - he’s now changing down to his bra on his lonesome.

If he had a leg to stand on he’d sue.

They are the very definition of unwinnable cases. If they had a chance GLP would be lining them up.

There are a couple of trans people, one of whom is Samantha Tempest, the other was granted anonymity, who are taking their employers (Defra and its ALBs) to court for allowing SEEN to exist, along with some of their colleagues who are/were co-chairs of the network. Possibly represented by a certain trans-identifying barrister.

I am not saying trans people aren't going to sue. But on the key grounds of FWS we are not seeing a wave of trans people wanting access to the loos. Perhaps when people start enforcing the law there might be more complainants.

I suspect Carol won't be too gleeful when Naomi walks her through her decision making on harassing Sandie Peggie mid trial via a statement published to all and sundry.

Whatever persona we've constructed for Carol, I assume the deconstruction in Tribunal will unmask much.

I wish there was a mole in NHS Fife A&E leaking gossip about who no longer speaks to who, what the reaction was to sackfuls of cards arriving addressed to Sandie, who’s off sick with stress after making a fool of themselves at the trial. That sort of thing. I hope someone had the wit to keep a diary (or contemporaneous notes on their phone) for a rainy day. I would have.
