NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Can Carol Potter be sued or cited individually in any fresh legal action by SP, Sex Matters, or anyone else who had aspersions cast upon them in that potentially damaging press release?

Good question

I remember when the statement came out. Naomi was incensed and rightly so. To hint that the threats had come from FWS (when they actually came from well known TRA actors and targeted NC and the judge) is peak DARVO.

Such a fond memory the squirrels 🐿️

Majorconcern · 01/12/2025 15:14

Where on earth did Fife get their legal advice from? It really was amateur squirrels, at best. (DH has checked my accounts, mostly right, so off to have a chocolate Christmas pudding)

I once saw Carol stop to let someone cross the road. She’s a saint.

Never mind her majority female workforce are being sexually harassed, whistleblowers are being bullied & she issued a statement edited 6 times suggesting a charity incited harm to her staff.

She’s my special friendly saint.

Just like it was Charles the first's decision to lose a bit of height from the top.

It really was amateur squirrels, at best.

I saw an amateur squirrel in real life once. It fell plonk out of a tree right in front of me and my dog, which certainly isn't the behaviour of a squirrel with any kind of professionalism.

weegielass · 01/12/2025 15:36

Came here to post the herald link but you guys are ahead of me.
How many legal cases does SP have now? The whole thing is a mess.
CP should not be allowed to just stand down all nicey nice.

Yep.

"In November, additional claims were raised against chief executive of NHS Fife, Carol Potter, and director of people and culture, David Miller.

Claims of victimisation were also raised against NHS Fife and chief executive Carol Potter arising from NHS Fife’s media statement on July 18, which was confirmed to be signed off by Ms Potter.

An additional claim of harassment against NHS Fife and David Miller arising from his “failure since June 2025 to provide Sandie Peggie with assurances that NHS Fife would not permit men, irrespective of their gender identity, access to female single sex workplace changing rooms”.

The claims are expected to be conjoined onto the existing claim lodged on August 6, according to Sex Matters, which is supporting Ms Peggie.

@BezMills Reminds me of Otis: Sad Song for Sad Times!

Majorconcern · 01/12/2025 16:05

Oh, Carol! you’ve been such a fool
Thought your staff would always back you
if you treat them cruel
When you’re caught it’s best to fess up
We all knew it was your mess up

One tribunal then another
Will they never end?
Though it’s hard, at least you’ve got one friend

You are me! I had the same thing happen when I was taking my son's dog for a walk. Luckily she was the best-trained dog in the whole universe and immediately obeyed my command to lie down, so the squirrel got away up another tree.

(I did once have a dog who chased a squirrel up a tree... we had the devil of a job getting the dog back down again. But my son's dog had more sense.)

On the subject of Carol: Al Stewart wrote a song which contained the lines
Oh Carol
I think it's time for running for cover
Uh-huh
(You've got a one way ticket for all of your yesterdays.)

Not sure how many cases SP is fighting now, but I'm picturing this scene at the end of them ...

Majorconcern · 01/12/2025 16:40

Don’t know the Al Stewart song, shall investigate. I was thinking of Neil Sedaka’s, Amarillo too difficult

MyThreeWords · 01/12/2025 16:43

My amateur squirrel survived thanks to my terrier also having a bit of an amateurish day, @AskingQuestionsAllTheTime . He was sort of "What?Wait! JESUS FUCK!!!", by which time the squirrel had scarpered in embarrassment.

LOVE the story of your dog shooting up a tree. I imagine he was like Tigger - better than going up than down.

AskingQuestionsAllTheTime · 01/12/2025 16:44

The Al Stewart is the first song on his album "Modern Times", I think. 1975. Not all of it is apposite, but the lines

Sometimes it seems impossible
That the game could get that rough,
But the stage is set, the exit's barred
And the make-up won't come off

Also seem to fit a little.

NebulousProfessorSupportPostcard · 01/12/2025 16:47

Here's David Miller, compassionate leader, who will have a starring role in the next SP tribunal. At last, another bloke other than Upton will be held to account.
