NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

👀👀👀👀👀👀

On tenterhooks!!!

Ack! Got my hopes up! Judgment for Sue Evans’ case - appeal to grant a judicial review of Gender Plus. Excellent news, but not quite what I was anticipating.

Now need to go lie down and let my heart rate settle 🤣

spannasaurus · 01/12/2025 12:43

The decision being announced in this link is for a judicial review against gender plus

Alpacajigsaw · 01/12/2025 12:43

What?!

Alpacajigsaw · 01/12/2025 12:44

cancels afternoon plans

Alpacajigsaw · 01/12/2025 12:45

Oh just seen it’s not SP. Bums! Oh well plans back on! Not that they’re that exciting!

Majorconcern · 01/12/2025 12:46

Oh God, it's back to the accounts, then. We are hallucinating Peggie decisions, like mirage oases in the desert

CarefulN0w · 01/12/2025 12:49

OMG I need an early lunch.edited now I’ve realised it’s not SP! Still any excuse to eat.

CautiousLurker2 · 01/12/2025 13:05

Vegemiteandhoneyontoast · 01/12/2025 13:11

It's quite understandable @CautiousLurker2 - you have my sympathy!

Alpacajigsaw · 01/12/2025 13:33

AmaryllisNightAndDay · 01/12/2025 13:43

jotters ae judgement

😂

NebulousProfessorSupportPostcard · 01/12/2025 14:04

Please can I check though: when the SP (or any other judgement is due) is it usual/likely that we will get an announcement like this about when to expect it on the day?

ProfessorFanOfBen · 01/12/2025 14:09

We may remark that it's 14:09 and no sign of it yet. This is going to hurt when it's actually the SP judgement - be prepared!

ProfessorFanOfBen · 01/12/2025 14:20

Oh, no, there is news - a complete loss, appeal refused. Pity.

Phew. Though still sad obvs.

ProfessorFanOfBen · 01/12/2025 14:31

Sorry! It's not obvious we have a thread about the Susan Evans case where the loss is (we must, but I can't conveniently search right now).

ProfessorFanOfBen · 01/12/2025 14:39

Omg, no wonder she had to go!

We have had this little update on the Herald though (apologies if it's already been posted)Outgoing NHS Fife Chief Executive Carol Potter signed off on a controversial press statement issued during the Sandie Peggie employment tribunal, the health board’s lawyers have admitted.Sandie Peggie latest: NHS Fife confirms CEO approved statement | The Herald

Are we surprised?

SirChenjins · 01/12/2025 14:45

Appalling - but not surprising. Surely to goodness this case must go in SP's favour?

Sayonara, Carol Potter - may the consequences of your actions be severe.

SeniorWranglerStanfreyPock · 01/12/2025 14:41

Are we surprised?

Only that they have actually admitted it before the next millenium😅
