NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

What an ordeal, let's hope you're now on an upward trajectory with no more hiccups. I'm just hoping that we will have some news which will give you a bit of a boost. Meanwhile, think of nice things

It has not been a picnic. When I was first admitted they were so concerned I realised that I could lose my leg or life to sepsis. I went a bit delirious just before the first operation to debride the wound because I had been taken off antibiotics and the infection had taken control.

There is metal in my ankle and they had to stop the antibiotics because it couldn't clean the infection on the metal and I would get reinfected. The operation was delayed but once I had it they put me on very strong IV antibiotics and then after a week of growing cultures, changed the regime.

I then needed another operation that was cancelled four times before they prioritised me and managed to close the wound. It then took two days to discharge me and I was prescribed 12 weeks of antibiotics by mouth. 18 days in hospital in total.

I am very fortunate to be at home and it's easy to think that because I am home, I must be fine. I am fine but I'm also still unwell and gradually improving and it will be mid January when I'm back to my old self.

Thank you all for your lovely support and kind comments, not just here but on other threads as well. I really do feel very cherished by this community of unknown women. ❤️

Well Big Sond did not make a judgement in November. Let's hope he makes one soon and of course that it's favourable.

BTW does any one know what Dr Upton is doing at the moment?

lol - I was thinking DU needed to do better than the sixth worst way of falsifying phone records?!

I would love to hear an interview about this case with Big Sond in a year or two when this does down. I too thought he must feel he drew the short straw but in the long term it’s a case that will go down in history and be studied in law schools. It’s made him famous!

I do nothing but sit on the sofa! I have a job application to finish and I'm not at my desk but sitting/lying with my feet up on my reclined sofa with extra pillows under my legs.

I knit, catch up with MN and watch a lot of TV.

I can drink (thank fuck because, you know, Christmas is in the middle of this), but not to excess. Not through willpower but because it tastes wrong and the antibiotics make it pass really quickly through my liver, so I don't enjoy it? No hangover though.

My DH is a star and cooks all the meals (he does all the cooking anyway) and has brought me food when I've been pasting. He's also taken on the sheets and towels laundry and dishwasher which are usually my responsibilities. I do have to get mobile though. The original operation was to fuse my ankle and I must exercise it to stop it being stiff.

That burgundy is my signature colour. DH is red for Liverpool FC and DSD loves turquoise. She took the stocking to her room where it is hung on the door to her wardrobe. I said they would go in the Christmas box in the loft in January and she asked if she could keep it. Of course! She's very touched that I made her something.

@MyrtleLion oh my goodness, what a heroine you are. I’ve been through something similar with sepsis and ended up on vac pumps to remove pus from feet, hands and chest. Just caused by campylobacter (whilst in hospital) apparently. Full recovery took a long while but I’m here to tell the tale and now fighting fit, albeit with a few scars.
You have been amazing, keeping up with the TT whilst so unwell. Sending you strength and healing.
