NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

My mother's reply to a wail of 'But they all have them/are going there/' or similar complaint about not having the same clothes or going to the same events as classmates:
'And if they were all jumping in a lake, would you jump in too?.

I realise now that it was because we hadn't enough money for nice clothes and school trips, but it stuck with me and I've never felt the pull of 'following the crowd', I've always, even as a teenager, gone my own way.

However, the independent thinking thing backfired on my parents, as I also turned out to be an atheist and a lesbian = two lakes they would have preffered me to follow the crowd intoSmile

I’ve had 3 names too - and was regularly misgendered including on my NI card when it arrived around my 16th birthday. I am sure I must still have cPTSD from that as I hate my first name being shortened because it is so masc [it’s triggering in fact] so perhaps I should consider suing the government for the trauma and prolonged distress…

My dad's [Eastern European] name was habitually mangled and he once found himself booked into a women's ward at the Vic (Kirkcaldy) for a pre-arranged op. (His forename is definitely a man's name in his country of birth but is similar to a name sometimes used as a women's name elsewhere. Mind you, his records definitely stated that he was a man, so someone at the Vic clearly didn't read his file properly.

As I think I said on one of the other threads, dad was a 6ft coalminer. He merely laughed and told his named nurse that it wasn't a problem for him: "That's aa right love - just so long as A've got a bed!"

I wasn't there at the time, but my mother was. According to her, the nurse didn't seem to realise that Dad was joking and seemed horrified. The medical team had no difficulty in finding him a bed in the men's ward.

If the judgement is in Sandie's favour, do you think they will find against both NHS Fife and Dr. Upton?

My understanding is that Dr. Upton is very likely to appeal. And there is speculation that this is the test case that could be taken all the way to the ECHR.

But if the judgement only rules against NHS Fife and not Dr. Upton, then presumably DU can't appeal? So in some respects, would that be a better outcome?

Neither Upton nor Fife could take it to the ECHR.

There might be an absolutely miniscule chance Peggie could - if she could persuade them that NHS Fife is an arm of the British government.

I think young people's emotions are being medicalised as mental health problems.

Children and teenagers have a heck of a lot of emotions to deal with - anxiety about exams, about being liked, about pets dying, maybe even about loved-ones dying... and they need lots of love and support to get over all these hurdles.
Being sad or worried or confused or whatever are emotional issues that can in most cases be worked through, and giving the label of 'mental health problems' to a sad or anxious or confused young person is medicalising their emotional states.
It may also be overstretching the limited services that a small number of young people desperately need, because they do actually have mental health problems.
