Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The hearing started on October 20th, with evidence starting on October 22nd and is scheduled to last 3 weeks. To view the hearing online requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. An alternative to X is to use Nitter: nitter.net/tribunaltweets or nitter.poast.org/tribunaltweets

The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

I understand where you and @CriticalCondition are coming from.

My perspective is, as I’ve said before, men can wear dresses and skirts, men can wear make-up, men can wear jewellery. If we didn’t force rigid sex based stereotypes on people we might have a society where men wearing dresses using men’s SSS would be accepted. Maybe non-conforming children wouldn’t be going down a medicalised path.

And I do wonder if this relates to why so many otherwise leftwing women (including feminists) try so bewilderingly hard to accommodate gender identity, because it seems to segue into the avant-garde movements of their younger days?

It feels familiar … and any discomfort felt can’t be expressed or they risk sounding like the disapproving parents they so despise(d).

The nurses were all questioned about how they heard about him coming off hormones to try for a child with his wife.
Why was he not questioned about this too?
He would have looked much more male if he was.
( Or did I miss a part of the questioning)

It does seem redundant for public access to the witness statements to be wrangled over now. I'd put that down as a win for the Trust. Access to the witness statements caused considerable mischief to NHS Fife.

The witness statements and evidence bundle are available in the tribunal room at the back. TT has no one on site (someone went first day as we had some concerns about whether our previous permission to report was still good). And if the statements are only 'in the room' then the only time they can be examined is while the tribunal is in session.

In Fife, the evidence bundle was in a different room and anyone who was admitted as an observer or press could go read it before the Tribunal started (remember all those delays?). This gave Maya and others time to copy out particularly interesting bits of the evidence bundle.

Thanks for sharing that@Madcats. I had seen in the Dale Henderson coverage that he was clinic manager of the dialysis unit. But it looks to me that in 2021 Diaverum retained rather than gained the contract which they'd already had for a decade or so. So DH might have been on the Darlington Hospital site when the unit was there but was employed by Diaverum not the Trust.

Ahh, so the person on the "HR bench" at the hearing who I couldn't recognise was Sue Williams. So that's been pretty much 4 HR or EDI people from the Trust attending the whole hearing.
