Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The NHS trust’s HR department dismissed the nurses’ concerns, stating they should “broaden their mindset” and “be educated”. The hearing started on October 20th, with evidence starting on October 22nd and is scheduled to last 3 weeks. To view the hearing online, requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

“Rose is a Transwoman therefore a male and he is indeed using the female CR. I have read the Trust policy on transition in the workplace which states that trans people get whatever they want whenever they want it so his use of the CR is in line with policy. No case to answer. Burn the witches but wait until after their legal action”.

Just sounds to me like all the fannying about that occurred was initially about a policy they were struggling to justify.

In all honesty it's not and never is a transperson issue, it is always a man issue. With binary sex based decisions made that somehow always subordinate and oppress women to the man. (And no one ever has any difficulty knowing which is which.)

He could have gone in and shut this down by removing RH from the changing room, citing the workplace regulations. It makes you wonder what on earth the legal team were advising.

He absolutely should have removed RH from the changing room, but the Workplace Regs aren’t relevant here. They’re about provision of facilities by an employer, they don’t deal with who uses them.

Deary deary me. AT effectively kicked the HS Regulations into the long grass and didn't incorporate his knowledge of them into the investigation. That is incredibly poor at best.

AT - not part of her briefing note for the investigation.
NF - TITWP policy made provision for people of one sex to make use of other facilities was under review. Was this relevant?

AT - to be honest it didn’t really cross my mind.
NF - you’ve interpreted the regulations.
AT - there’s an assumption here that everything I did was to cause harassment. That was never my intention.
