"Darlington Nurses" vs County Durham and Darlington NHS Trust Tribunal Thread 2

Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The NHS trust’s HR department dismissed the nurses’ concerns, stating they should “broaden their mindset” and “be educated”. The hearing started on October 20th, with evidence starting on October 22nd and is scheduled to last 3 weeks. To view the hearing online, requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

I'm guessing it's the reason SC told the judge at the directions hearing RH would not be available in September.

He's got a decision to make next week. I think the only references to the clothes he wears to work have been to jeans, men's trainers and, of course, The Boxers. There's been no suggestion so far he wears anything 'womanly' to work. So will he turn up as Pete in a blokey suit or as Pete in a dress to convince the tribunal of his womanliness. The wedding photos won't be in the agreed bundle and I can't see the judge agreeing that they can go in now.

I wonder if SC has prepared different sets of questions depending on how he presents.

Indeed. Most women working on the hospital floor barely have time for a wee during a shift, never mind extended wandering about.

I expect Rose's solicitor to provide explanations for why he was wandering about - and maybe to produce lace boxers. Whether the "explanations" will make any sense we'll have to wait and see.

Hello. I’m trying to catch up with proceedings. And I’m trying to work out the likely date for Rose’s appearance so I can try to get some more press about our NHS Audit…. The hearing is scheduled for 3weeks? We are through week 1 where Karen did 2-3 days? Am I right in thinking that there are 3 more nurses and possibly some other witnesses - let’s say the whole week on claimant witnesses? So might Rose be early in week beginning 3rd Nov? What do you think?

Edited to add: At the moment, the scheduling information given by counsel in the hearing is that cross-examination of the respondent's witnesses starts on Wednesday, 29 October 2025.

With the hearing scheduled to end on 14 November 2025. I'd guess that the final 2 days will be closing arguments.

Banned here in another eminency, It is interesting if true that Roses dad is a sex offender i have read more than once that it is a common feature in male adults identifying as a woman.

i think it is something that ought to be investigated. Sexual violence against children is so not dealt with properly, and there seems to me to be a link for at least some males with gender identity.

Do we have anything definitive yet that this Dale Henderson is definitely Rose's dad? If true, it's important. But it's a hell of a thing to be repeating if it's actually a different Dale Henderson.

Wondering what profession even an "expert on single sex spaces" might be. Surely a court full of legal people can't call another legal person to explain the law to them? But struggling to see what else it is they need a witness on other than who exactly is entitled to what and why?

There are threads on Twitter with family photos of them together from fb, and info about Dale performing in panto locally in local news (naming his children).
