NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

For those observing, you are hearing JR's repeated misnaming - it is something that is worth registering a complaint about with her professional body?

Open justice has allowed us to observe a trial and one of the barristers appears to be deliberately misnaming someone, apparently for the purposes of ridicule?

Is this something that usually happens in a UK tribunal?

It almost beggars belief that JR is a KC, given the sheer woolliness and lack of clarity in what she appears to be saying. I say appears because the contrast with NC's cogent analytical reasoning and clarity of language is almost shocking to this non-legal observer. Heaven only knows what the panel is making of it.

Yes, I felt it was unfortunate given Maya's Jewish heritage. Personally I'd tread much more carefully on that one if I were JR, especially if I wanted to create moral distance between my client and Sandie on the grounds of racism.

After all, JR could mispronounce a Jewish person's name to make a stupid point in a different way. I'd also avoid anything that makes it sound at all German for the same reason. Giving her the benefit of the doubt that it isn't anti-Semitic, it is stupid.

I'm fairly sure She has done it directly to Maya when Maya was on the stand and Maya hasn't pulled her up, so I think it's a case of just let her keep embarrassing herself

JR Agreed fact DU had permission to use F CR. C submission - she says obligation to carry out Impact assessment. Failure to do that isn't actionable in this tribunal. C Complains not consideration of advice to others. But aligns - KS/IB/Code of practice - IB said could have confidence UK Eq body has balanced different needs.

C asserts board were aware she had raised concerns. But IB evidence was that she had only been told that a t member of staff was going and she was asked to accommodate them re CR - wasn't told whether TM or TW.
